MARCH 11, 1999

 

The City Council of the City of Sunnyvale and Sunnyvale Redevelopment Agency met jointly in a Special Meeting in the City Council Chambers, 456 W. Olive Avenue, Sunnyvale, California, at 7:00 p.m., with Mayor Manuel Valerio presiding.

The Sunnyvale City Council took action on Council Agenda Items 1a through 1f.

PUBLIC HEARINGS/GENERAL BUSINESS

1.

RELATED PROPOSALS FOR A 37.5 ACRE SITE LOCATED AT 1001,

1326 AND 2502 TOWNCENTER LANE; 296 SOUTH MATHILDA; 390 WEST MCKINLEY AVENUE; 200 WEST WASHINGTON AVENUE; 211 WEST IOWA AVENUE; IN THE DSP/18, 18a AND 18b (DOWNTOWN SPECIFIC PLAN SUBDISTRICTS 18, 18a AND 18b) ZONING DISTRICTS. (AMERICAN MALL PROPERTIES LLC., CITY OF SUNNYVALE REDEVELOPMENT AGENCY AND CITY OF SUNNYVALE)

Trudi Ryan, the Planning Officer, presented the staff report. Dyane Matas, Housing & Neighborhood Preservation Officer, and Ray Williamson, City Traffic Engineer, were also available to respond to Council questions.

The public hearing was declared open at 7:20 p.m.

The following speakers represented the applicant and addressed issues raised at the Planning Commission level regarding parking, traffic, size of theater, seating in theater, security, traffic mitigation:

At this time Jerald Schutte, Principal/American Mall Properties, LLC., responded to questions raised by Council and public. Mr. Schutte concluded by requesting City Council support to restoring theater seats to 4,000 and approval of the staff recommendation.

REPORT NO. 99-093

ITEM 1A

CERTIFICATION OF FINAL ENVIRONMENTAL IMPACT REPORT FOR THE TOWN CENTER MALL MODIFICATIONS PROJECT.

ROBERTS moved certification of the Final Environmental Impact Report for the Town Center Mall Modifications Project, seconded by KAWCZYNSKI and carried with WALKER absent.

 

ITEM 1B

AMEND THE DOWNTOWN SPECIFIC PLAN LAND USE DESIGNATION AND BLOCK NUMBER FOR PORTIONS OF BLOCK 18a (FRONTING MATHILDA AVENUE) AND BLOCK 18b (PARKING STRUCTURE) TO BLOCK 18 TO ALLOW REGIONAL RETAIL USES.

Title of Resolution No. 119-99:

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING THE SUNNYVALE DOWNTOWN SPECIFIC PLAN PERTAINING TO LAND USE DESIGNATION TO EXPAND REGIONAL RETAIL USES AND CHANGING THE BOUNDARY OF BLOCK 18 TO INCLUDE BLOCK 18B AND PORTIONS OF BLOCK 18A.

ROBERTS moved adoption of Resolution No. 119-99, seconded by KAWCZYNSKI and carried by the following roll call vote:

AYES: ROBERTS, VORREITER, VALERIO, KAWCZYNSKI,

FOWLER, MILLER

ITEM 1C

INTRODUCTION OF ORDINANCE: REZONE PORTIONS OF THE DOWNTOWN SPECIFIC PLAN/SUB-DISTRICTS 18A AND 18B TO THE DOWNTOWN SPECIFIC PLAN/SUB-DISTRICT 18 ZONING DISTRICT.

Title of Ordinance No. 2590-99:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING THE PRECISE ZONING PLAN, ZONING DISTRICTS MAP AND THE DOWNTOWN SPECIFIC PLAN TO REZONE CERTAIN PROPERTY LOCATED AT DOWNTOWN SPECIFIC PLAN SITES FROM SUBDISTRICT 18A AND 18B TO DOWNTOWN SPECIFIC PLAN SUBDISTRICT 18.

ROBERTS moved introduction of Ordinance No. 2590-99, seconded by KAWCZYNSKI and carried by the following roll call vote:

ITEM 1D

INTRODUCTION OF ORDINANCE AMENDING SECTION 19.30.160 TO COMBINE SUBDISTRICT 18B WITH SUBDISTRICT 18 OF THE DOWNTOWN SPECIFIC PLAN.

Title of Ordinance No. 2591-99:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING SECTION 19.20.160 OF THE SUNNYVALE MUNICIPAL CODE BY COMBINING SUBDISTRICT 18B WITH SUBDISTRICT 18 OF THE DOWNTOWN SPECIFIC PLAN.

ROBERTS moved introduction of Ordinance No. 2591-99, seconded by KAWCZYNSKI and carried by the following roll call vote:

AYES: ROBERTS, VORREITER, VALERIO, KAWCZYNSKI,

FOWLER, MILLER

NOES: NONE

ABSENT: WALKER

 

ITEM 1E

SPECIAL DEVELOPMENT PERMIT TO ALLOW CONSTRUCTION OF AN 82,000 SQ. FT. (4,000 SEAT), 20-SCREEN CINEMA; APPROXIMATELY 205,000 SQ. FT. OF OTHER ADDITIONAL RETAIL, RESTAURANT AND ENTERTAINMENT SPACE; REMOVAL OF THE CENTRAL PORTION OF THE EXISTING TWO-LEVEL PARKING STRUCTURE AND CONSTRUCTION OF TWO NEW PARKING STRUCTURES LOCATED AT THE CORNERS OF WASHINGTON/SUNNYVALE AVENUES AND IOWA/SUNNYVALE AVENUES.

ROBERTS moved approval of the special development permit in accordance with staff recommendation, seconded by VORREITER.

MILLER moved to amend the motion to reflect theater seating from 4,000 to 3,500. The motion died for lack of second.

The original motion to approve special development in accordance with staff recommendation carried with MILLER dissenting and WALKER absent.

 

ITEM 1F

TENTATIVE MAP TO CREATE NINE PARCELS WHERE ELEVEN CURRENTLY EXIST.

ROBERTS moved approval of tentative map with findings 1 through 8, seconded by KAWCZYNSKI and carried with WALKER absent.

2.

PROPOSED EXCHANGE OF LAND FOR DEVELOPMENT OF PARKING STRUCTURES ON SUNNYVALE AVENUE RELATED TO THE REDEVELOPMENT OF TOWN CENTER.

REPORT NO. 99-092

STAFF RECOMMENDATION

That Council adopt the resolution.

The public hearing was declared opened and closed at 12:05 a.m.

Title of Resolution No. 120-99:

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AUTHORIZING THE CITY MANAGER ON BEHALF OF THE CITY OF SUNNYVALE TO EXECUTE ALL DOCUMENTS AND ACCEPT DEEDS AND GRANTS WITH RESPECT TO THE EXCHANGE OF CERTAIN REAL PROPERTY LOCATED AT TOWN CENTER.

ROBERTS moved adoption of Resolution No. 120-99, seconded by KAWCZYNSKI and carried by the following roll call vote:

AYES: ROBERTS, VORREITER, VALERIO, KAWCZYNSKI,

FOWLER, MILLER

ACTION ON REDEVELOPMENT AGENCY ITEM IS LISTED UNDER SEPARATE MINUTES WHICH WILL BE APPROVED AT THE NEXT REDEVELOPMENT AGENCY MEETING.

NON-AGENDA ITEMS AND COMMENTS

COUNCIL

NAC-1

Councilmember Kawczynski commented that he attended the Information & Technology Steering Committee meeting at the National League of Cities Conference in Washington, D.C. (March 5-9, 1999) Councilmember Kawczynski referred to discussion on the internet tax moratorium and it’s impact on the community.

NAC-2

Councilmember Miller indicated that she was recently appointed to the NLC Policy Committee on Human Development. Councilmember Miller’s appointment was made at the National League of Cities Conference held in Washington, D.C. (March 5-9, 1999)

ADJOURNMENT

There being no further business the Mayor declared the meeting adjourned at 12:10 a.m.
