SUNNYVALE CITY COUNCIL
MARCH 23, 1999

 

The City Council of the City of Sunnyvale met in a regularly scheduled meeting in the City Council Chambers, 456 W. Olive Avenue, Sunnyvale, California, at 7:30 p.m., with Mayor Manuel Valerio presiding.

PUBLIC ANNOUNCEMENTS

Ms. Jackie Harrison, Sunnyvale’s representative to the System Advisory Board Silicon Valley Library System. Ms. Harrison invited Council and the City Manager to the annual joint breakfast for local government officials and community leaders to be held at the Stanford Park Hotel on Saturday, April 24, 1999 from 8:30 – 11:00 a.m. Speakers will be Ruben Barrales, President & CEO Joint Venture Silicon Valley Network and Mayor Ron Gonzales, City of San Jose.

 

CONSENT CALENDAR

1A.

APPROVAL OF MINUTES (March 11, 1999 and March 16, 1999)

MILLER moved approval of minutes as *amended, seconded by WALKER and carried unanimously.

*Councilmember Miller made the following correction to page one of the minutes dated March 16, 1999:

Councilmember Miller announced the Blue Ribbon Water Transit Task Force – South Bay forum scheduled meeting on April 12th at 1:00 p.m. at NASA Ames Conference Center.

LIST OF CLAIMS AND BILLS APPROVED FOR PAYMENT BY THE CITY MANAGER.

REPORT NO. 99-117

STAFF RECOMMENDATION

That Council review the lists of bills.

VORREITER moved approval of the review of claims and bills, seconded by MILLER and carried unanimously.

1C.

AWARD OF BID #F9903-80: AUTHORIZATION FOR ADDITIONAL EXPENDITURES FOR TEMPORARY LABORATORY PERSONNEL.

REPORT NO. 99-121

STAFF RECOMMENDATION

That Council authorize additional expenditures not to exceed $105,000 under the existing contract with Lab Support, Inc., of San Jose for temporary laboratory personnel at the Water Pollution Control Plant and authorize the Purchasing Officer to modify the existing contract to that effect.

GRANT APPLICATION TO PACKARD FOUNDATION FOR NEXT STEP, YOUTH EMPLOYMENT READINESS AND VOLUNTEER PROGRAM.

REPORT NO. 99-118

STAFF RECOMMENDATION

That Council approve the application for $15,000 to obtain a grant from Packard Foundation for the Next Step volunteer and employment readiness program.

ADOPTION OF ORDINANCE NO. 2592-99: AWARD OF TAXICAB FRANCHISE TO WEST VALLEY CAB COMPANY.

STAFF RECOMMENDATION

That Council adopt the ordinance.

Title of Ordinance 2592-99:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AWARDING NONEXCLUSIVE FRANCHISE TO BARBIR SINGH DOING BUSINESS AS WEST VALLEY CAB COMPANY.

VORREITER moved adoption of Ordinance No. 2592-99, seconded by MILLER and carried by the following roll call vote:

REPORT NO. 99-115

STAFF RECOMMENDATION

That Council adopt the resolution.

Title of Resolution No. 123-99:

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE DECLARING WEEDS TO BE A NUISANCE AND SETTING A PUBLIC HEARING FOR MARCH 30, 1999.

VORREITER moved adoption of Resolution No.123–99, seconded by MILLER and carried by the following roll call vote:

1H.

ADDITION TO COUNCILMEMBER KAWCZYNSKI’S FY 1998/99 TRAVEL BUDGET.

Vice-Mayor Vorreiter removed this item from the Consent Calendar for discussion.

REPORT NO. 99-119

STAFF RECOMMENDATION

That Council authorize an increase in the amount of $3,000 for Councilmember Kawczynski’s travel budget for FY 98/99.

The public hearing was declared open and closed at 7:45 p.m.

VORREITER moved to authorize an increase in the amount of $3,000 for Councilmember Kawczynski’s travel budget for FY 98/99 with the proviso that there would be no additional funds expended from the Council travel budget, seconded by FOWLER and carried unanimously.

1I.

AMENDMENTS TO CLASSIFICATION PLAN AND SALARY RESOLUTION: DEPUTY CITY MANAGER.

Ms. Frances Rowe removed this item from the Consent Calendar for discussion. Ms. Rowe asked the City Manager why the position of Deputy City Manager was being created.

That Council adopt the resolutions.

Title of Resolution No. 124-99:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING THE CLASSIFICATION PLAN OF THE CIVIL SERVICE BY CREATING THE JOB CLASSIFICATION TITLE OF DEPUTY CITY MANAGER AND BY ADDING THE CLASSIFICATION SPECIFICATIONS THEREFOR.

VORREITER moved adoption of Resolution No. 124-99, seconded by FOWLER and carried by the following roll call vote:

KAWCZYNSKI, FOWLER, MILLER

Title of Resolution No. 125-99:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING RESOLUTION NO. 155-98, THE CITY’S SALARY RESOLUTION, BY ADDING SALARY CONTROL POINT FOR THE NEW CLASSIFICATION OF DEPUTY CITY MANAGER.

VORREITER moved adoption of Resolution No. 125-99, seconded by FOWLER and carried by the following roll call vote:

PUBLIC HEARINGS/GENERAL BUSINESS

CONSIDERATION OF AMENDMENTS TO THE SUNNYVALE MUNICIPAL CODE TITLE 19 CONCERNING THE LOCATION OF CHILDCARE CENTERS.

REPORT NO. 99-122

STAFF RECOMMENDATION

That Council approve the Negative Declaration, approve the Zoning Code modifications as recommended by staff and the Planning Commission and to incorporate changes as listed in staff report items 2 a) through 2 e).

David Boesch, Director of Community Development, presented the staff report. Gerri Caruso, Associate Planner, was available to answer questions.

Vice-Mayor Vorreiter proposed that an assertive effort from staff be undertaken to educate corporations about child care opportunities.

The public hearing was declared opened at 8:21 p.m.

Appearances:

Liz Gallegos, Chair of the Child Care Advisory Board

Ms. Gallegos stated the purpose of brining this issue to Council was to address the needs of availability of child care, and the intent of the Child Care Advisory Board is to enable more child care centers.

The public hearing was declared closed at 8:28 p.m.

APPEAL OF THE ADMINISTRATIVE HEARING AGENDA OF MARCH 10, 1999.

REPORT NO. 99-114

STAFF RECOMMENDATION

That Council review agenda and appeal an application where appropriate.

No action taken.

 

CITIZENS TO BE HEARD

Boutros Negma thanked the Mayor and requested assistance on private legal issues. Mayor Valerio advised Mr. Negma to obtain legal assistance, and the telephone number for the Legal Aid Society can be provided to him.

NON-AGENDA ITEMS & COMMENTS

NAC-1 Councilmember Kawczynski commented on item 1H. of the consent calendar. Two ideas he obtained while attending the U.S. Conference of Mayors in prior years were the Community Care Fair and the MOMS pasta sauce program.

NAC-2 Councilmember Fowler announced he attended the Rotary Club’s Kids Fishing Day at Vasona Park on Saturday.

NAC-3 Councilmember Miller announced that Mayor Valerio, Councilmember Kawczynski and she attended the Sunnyvale Southern Little League Opening Day. She thanked them and wished them a good season.

NAC-4 Councilmember Miller announced the Ferry Service South Bay Forum meeting to be held on Monday, April 12th at 1:00 at the NASA Ames Conference Center.

NAC-5 Councilmember Miller asked staff how many acres are included in the Futures Study, any that had a FAR above 50%, and what year the Futures Study was adopted. She requested a Study Issue to review Futures Study and zoning of areas which contain Floor Area Ratios greater than 35% and do not require Planning Commission and Council review.

NAC-6 Councilmember Kawczynski requested copies of two reports from Staff on the Jay Paul Macara/Maude properties.

NAC-7 Councilmember Fowler announced that the Sunnyvale Little League had opening day this past weekend and the Lakewood Youth Baseball Little League would have their opening day this coming Saturday at Lakewood Park.

NAC-8 WALKER moved to agendize for a future Council meeting the banning of wood burning fireplaces in new construction. Motion modified for staff to obtain information from the City of San Jose and Palo Alto and provide Council a status report on the efforts required to address banning of wood burning fireplaces in new construction, seconded by VORREITER and carried unanimously.

NAC-9 Councilmember Kawczynski announced that he and Vice-Mayor Vorreiter attended the National Little League opening day at Washington Park.
