SUBJECT: Pre-Appeal of the Planning Commission Agenda of September 27, 1999 and the Administrative Hearing Agenda of September 29, 1999

REPORT IN BRIEF

This report represents Planning Commission and Administrative Hearing items that may be pre-appealed by a majority vote of the Council. Council should indicate those items on which it wishes to have expanded notification.

A. Pre-Appeal of the Planning Commission Agenda of September 27, 1999

    1. Hanh Nguyen: Applications for related proposals for a property located at 161 Waverly Street in an R-2 (Low-Medium Density Residential) Zoning District. (APN: 165-15-034) DP (Negative Declaration)

1999-0934 – Application for a Rezone from R-2 (Low-Medium Density Residential) to R-2/PD (Low-Medium Density Residential/Planned Development).

1999-0935 – Application for a Special Development Permit to allow construction of 3 townhome units.

    1. Laurie & Alex Trujillo (Thomas Whitford): Applications for related proposals for a property located at 323 Beemer Avenue in an R-2 (Low-Medium Density Residential) Zoning District. (APN: 204-51-024) DRP (Negative Declaration)

1999-0736 – Application to Rezone from R-2 (Low-Medium Density Residential) to R-2/PD (Low-Medium Density Residential/Planned Development).

1999-0737 – Application for a Special Development Permit to allow construction of a new single-family residence on a flag lot and an addition of a two-car detached garage to an existing residence on the front lot.

1999-0738 – Application for a Parcel Map to allow subdivision of one parcel into two lots

B. Pre-Appeal of the Administrative Hearing Agenda of September 29, 1999
    1. 1999-0958 – Application for a Variance to allow a 2-foot sideyard setback where a minimum of 6 feet is required and a 6-foot rear yard setback where a minimum of 10 feet is required. The property is located at 1369 Selo Drive in an R-1 (Low Density Residential) Zoning District. (APN: 323-09-040) DRP
    2. 1999-0963 – Presbytery of San Jose (Richard Fremd): Application for a Use Permit to allow a private memorial garden for interment of human ashes. The property is located at 728 W. Fremont Avenue in a PF (Public Facilities) Zoning District. (APN: 323-06-001) DSW

RECOMMENDATION

The Council should review the agenda and appeal an application where appropriate.
