SUNNYVALE CITY COUNCIL
NOVEMBER 23, 1999

 

The City Council of the City of Sunnyvale met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:30 p.m., with Mayor Manuel Valerio presiding.

SALUTE TO THE FLAG

The color guard and salute to the flag was led by Boy Scout Troop No. 466.

INVOCATION

The invocation was led by Minister Reverend Steve Harrington of the Presbyterian Church of Sunnyvale.

PUBLIC ANNOUNCEMENTS

Craig Crawford encouraged everyone to attend the Lakewood Village Neighborhood Association’s Annual Parade on December 11, 1999 at 11:00 a.m., which will begin at Lakewood Park and end at Fairwood Park.

Vice Mayor Vorreiter announced that a closed session regarding employee performance evaluations for the City Manager and City Attorney was held on November 22, 1999, and that direction would be given to staff as a result of that meeting.

Mayor Valerio congratulated Councilmember Miller on her appointment to the Association of Bay Area Government’s (ABAG) Bay Area Economic Forum for a two-year term.

Mayor Valerio congratulated Vice Mayor Vorreiter on her appointment as Secretary/Treasurer of the Executive Board of the Santa Clara County Cities Association.

Mayor Valerio acknowledged and thanked the following dignitaries in the audience for their presence: State Senator John Vasconcellos, County Assessor and former City Councilmember Larry Stone, Palo Alto Councilmembers Liz Kniss and Dena Mosser, Foothill DeAnza Community College Board Trustee Dolly Sandoval, former Vice Mayor Landon Knoll, and Congresswoman Anna Eshoo.

CONSENT CALENDAR

Vice Mayor Vorreiter moved, and Councilmember Miller seconded, approval of the Consent Calendar as presented. The motion carried unanimously.

Staff Recommendation: Review the lists of bills.

Approval of Final Map-Masonic Oaks, Tract #9174 (SD-99-3).

Staff Recommendation: Approve the Final Map and authorize the execution of the Subdivision Agreement for the subject subdivision.

Acceptance of Improvements – MacDowell Terrace Tract 8536 (SD-92-3).

Staff Recommendation: Accept, by resolution, the subdivision MacDowell Terrace, located at the northwest corner of Remington Drive and Azure Street as complete and satisfactory. The project consists of nine residential lots plus one common lot.

Resolution No. 203-99: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE ACCEPTING PUBLIC IMPROVEMENTS CONSTRUCTED IN MACDOWELL TERRACE, TRACT NO. 8536, SD-92-3 AS COMPLETE AND SATISFACTORY.

Award of Contract, Hetch-Hetchy Greenway (Morse Avenue to Borregas Avenue) Improvement Project (PR-96/02A-99).

Staff Recommendation: (1) Award contract to the lowest responsible bidder, Watkin & Bortolussi, Inc., for the Base Bid and Additive Alternate No. 1, in the amount of $386,626, and approve a construction contingency of $58,000; (2) Approve and authorize the filing of the Notice of Determination.

PERS Health Insurance Amendment - Management and SEIU.

Staff Recommendation: Adopt a resolution amending the City’s contribution for health insurance with PERS to conform to the Public Employees’ Medical and Hospital Care Act and MOU provisions and a resolution amending the Salary Resolution to reflect the change in contribution.

Resolution No. 204-99: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE FIXING THE CITY’S CONTRIBUTION AS EMPLOYER UNDER THE PUBLIC EMPLOYEES MEDICAL AND HOSPITAL CARE ACT FOR CERTAIN RETIREES.

Award of Contract for Laboratory Testing Services for the Water Pollution Control Plant (F9911-41).

Staff Recommendation: Award a one-year contract in an amount not to exceed $47,000 to Pacific Eco Risk Laboratories of Martinez to provide laboratory testing services for the Water Pollution Control Plant and authorize the Purchasing Officer to issue a purchase order to that effect.

Staff Recommendation: Award a contract in the amount of $106,436 to West Star Distributing, Inc., of Hayward and authorize the Purchasing Officer to issue a purchase order to that effect.

Staff Recommendation: Award a contract in the amount of $102,212 to Bearcat Manufacturing, Inc., of Wickenburg, Arizona, and authorize the Purchasing Officer to issue a purchase order to that effect.

Award of Bid for an Asphalt Patch Truck (F9910-35).

Staff Recommendation: Award a contract in the amount of $105,151 to Mission Valley Ford, a division of Sterling Truck Sales, Inc., of San Jose, and authorize the Purchasing Officer to issue a purchase order to that effect.

Application for Special Development Permit to allow an exterior renovation and the addition of 2,243 sq. ft. of floor area to an existing office building at 1245 Oakmead Parkway / AmBex Venture Group, LLC (ARC TEC) APPLICATION WITHDRAWN BY APPLICANT.

Mayor Valerio stated that the application had been withdrawn and no action was required.

Appeal of Planning Commission Agenda of November 8, 1999 and Administrative Hearing Agenda of November 10, 1999.

No action was taken on this item.

SPECIAL ORDERS OF THE DAY

Mayor Valerio recognized and thanked Lenore Wilcox, who recently retired from her position as Secretary to the Mayor and City Council. He stated that although she was not present for the meeting, her gift would be presented to her at a later time.

SOD-1

Recognition of Outgoing City Councilmember Stan Kawczynski.

Mayor Valerio recognized outgoing Councilmember Kawczynski for his nine-year tenure of service on the City Council, and wished him the best. He then presented Councilmember Kawczynski with a plaque and a gift, an educational savings bond in his daughter’s name.

Councilmember Kawczynski thanked the citizens for the opportunity to serve on the Council, and thanked all of his supporters. He further thanked everyone who made Sunnyvale a safe and beautiful city, and expressed his appreciation to the city employees for their hard work. He further announced his future plans for his start-up software company to go public, and his intent to run for State Assembly next year.

Oath of Office for Councilmembers-Elect Tim Risch, Manuel Valerio, Pat Vorreiter, and Jack Walker.

Mayor Valerio introduced Congresswoman Anna Eshoo.

Congresswoman Eshoo congratulated Mayor Valerio on his successes as Mayor and Councilmember. She then congratulated outgoing Councilmember Kawczynski.

Congresswoman Eshoo thanked the Council for the honor of presenting the oath of office, and proceeded to administer the oath of office to Councilmembers Risch, Valerio, Vorreiter, and Walker. She also presented them with Certificates of Election.

ABSENT: None

Councilmember Risch introduced his mother Winnie, sister Cindie, Aunt Dorothy, and Planning Commissioner Yolanda Brown, and thanked his campaign manager and others for their support throughout his campaign. He also thanked the City Manager and City staff. He further stated that the citizens are proud of their city, and that he would work positively and proactively to make Sunnyvale an even better place to live.

Selection of Mayor and Vice Mayor for 1999-2000.

Staff Recommendation: Select a Mayor and Vice Mayor for the term of 1999-2000 in accordance with Council Policy 7.3.6.

Mayor Valerio opened nominations for the office of Mayor.

Councilmember Walker nominated Vice Mayor Vorreiter to serve as Mayor for 1999-2000. There being no second necessary, the motion carried unanimously.

Mayor Vorreiter recognized Councilmember Valerio for his service as Mayor, and stated that he had provided strong, effective leadership, and was a good representative of the city. She then presented him with a plaque and a gift, a desk clock, commending his service as Mayor.

Councilmember Valerio stated that it was a pleasure and an honor to serve the residents. He then thanked Mayor Vorreiter for her support as Vice Mayor, thanked all of his supporters, and highlighted many accomplishments of the City Council during the past year. He proceeded to introduce his mother, Beatriz Valerio, and thanked her for her support.

Mayor Vorreiter opened nominations for the office of Vice Mayor.

Councilmember Fowler nominated Councilmember Walker to serve as Vice Mayor for 1999-2000. There being no second necessary, the motion carried unanimously.

Vice Mayor Walker thanked all of his supporters, in particular Carol Butler, former Deputy City Clerk, Ann Patti, his treasurer, Councilmember Valerio, and Michael Zamanski. He then introduced his daughter, Jennifer, who turned 18 this year. He further stated that he looked forward to the next four years, and commended former Councilmember Kawczynski for his service.

Selection of Seating Arrangements for City Councilmembers for 1999-2000.

Staff Recommendation: Select seats for the coming year in accordance with Council Policy 7.3.7.

By unanimous consent, the City Council seating arrangement for 1999-2000 is as follows (from left to right, from the audience): Councilmember Fowler, Councilmember Valerio, Vice Mayor Walker, Mayor Vorreiter, Councilmember Roberts, Councilmember Miller, Councilmember Risch.

COUNCIL

Mayor Vorreiter spoke from the podium and presented her remarks as the new Mayor for 1999-2000. She introduced her family members present (four generations), including her mother Florence Wolfe, her husband John Vorreiter, her daughter Riane Spalding, her son Loren Vorreiter and his wife Katie, and her grandsons Logan and Kyle, and her granddaughter Corrina.

Mayor Vorreiter thanked all of the Councilmembers for their dedicated service and explained the offices that each Councilmember holds beyond his or her duties on the Council, including committee and board membership and leadership positions. She stated that 2000 will be an exciting year of celebration, and that she wants to be a good spokesperson and wishes to gain ideas from the community. She further stated that she wants to foster a theme of celebrating diversity in the community. In addition, she stated that there will be established a "Moment of Opportunity" at the beginning of each Council meeting, whereby a community group can share information about what they do and who they serve.

ADJOURNMENT

There being no further business, Mayor Vorreiter declared the meeting adjourned at 8:27 p.m.
