Approval is requested for the award of a three-year contract to Bert Espinosa, Medical Technologist, of Sunnyvale, for drug and alcohol testing services for the Department of Public Safety (DPS).

The City has contracted with Bert Espinosa for the past 18 years. He is a local medical technologist who performs blood alcohol test, urinalyses, and intoxilyzer tests. Mr. Espinosa is a specialist in a relatively unique field, is a Sunnyvale resident, and is on call for testing on a 24-hour basis. The need for these services has grown significantly over the years due to the escalation of traffic and the subsequent traffic occurrences.

All tests are performed at Stanford Hospital, El Camino Hospital, Kaiser Hospital (Santa Clara), the Sunnyvale Public Safety Building, or a designated facility between Santa Clara and Stanford. Other local testing laboratories do not perform ALL of the required tests.

Bert Espinosa has offered firm rates for the next three years: $60/blood alcohol test; $60/ urinalysis; $60/intoxilyzer analysis; and $40/refusal or cancellation.

Section 2.08.030 exempts from competitive bidding "contracts involving the obtaining of professional or specialized services".

Costs are estimated at $30,000 per year or $90,000 for the three-year contract. Funds for these services are available in Public Safety Account #412950-5180.

It is recommended that Council award a three-year contract in an amount not to exceed $90,000 to Bert Espinosa, Medical Technologist, of Sunnyvale, to provide laboratory testing services for the Department of Public Safety and authorize the Purchasing Officer to issue a purchase order to that effect.
