SUBJECT: Award of Contract for Laboratory Testing Services at the Water Pollution Control Plant (F9911-41) (RTC #99-490)

REPORT IN BRIEF

Approval is requested for the award of a one year contract to Pacific Eco Risk Laboratories of Martinez to provide laboratory testing services for the Water Pollution Control Plant (WPCP).

BACKGROUND

The National Pollutant Discharge Elimination System (NPDES) permit issued to the WPCP by the California Regional Water Quality Control board in June 1998 requires the City to monitor chronic toxicity in the WPCP discharge area by testing its effect on the most sensitive indigenous species in that area.

After a review of potential testing laboratories, Pacific Eco Risk Laboratories was selected as the firm best qualified to provide these services; and a service contract was executed. Up to this time, the contract value did not require Council award.

DISCUSSION

During Calendar Year 2000, however, WPCP staff anticipate a more aggressive testing schedule and expenditures in excess of $35,000. At this time, staff anticipates six rounds of accelerated bi-weekly testing instead of last year’s four with the potential for additional or emergency testing, if required.

Section 2.08.030 of the Sunnyvale Municipal Code exempts from competitive bidding contracts for professional or specialized services.

FISCAL IMPACT

The annual estimated cost of the required services is $42,000. In addition, staff requests a contingency of $5,000 for additional and/or emergency services, thereby increasing the total authorized expenditures to $47,000. Funds are available in Public Works Account #335050. Pacific Eco Risk Laboratories is willing to hold its current pricing through December 31, 2000.

RECOMMENDATION

It is recommended that Council award a one year contract in an amount not-to-exceed $47,000 to Pacific Eco Risk Laboratories of Martinez to provide laboratory testing services for the Water Pollution Control Plant and authorize the Purchasing Officer to issue a purchase order to that effect.
