SUNNYVALE CITY COUNCIL
DECEMBER 7, 1999

The City Council of the City of Sunnyvale met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:32 p.m., with Mayor Vorreiter presiding.

SALUTE TO THE FLAG

The salute to the flag was led by Mayor Vorreiter.

SPECIAL ORDER OF THE DAY

Mayor Vorreiter presented a Proclamation to Charles "Chuck" Stowell, recognizing Chuck’s Produce and the Stowell Family on the occasion of the closing of Chuck’s Produce, and acknowledging the Stowell Family’s century of contributions to Sunnyvale.

PUBLIC ANNOUNCEMENTS

Yolanda Brown, Planning Commissioner, and Chair of the Census 2000 Committee, spoke of the importance of a complete census count and gave examples of ways people could become more involved in the effort.

Councilmember Fowler reminded everyone of the Lakewood Holiday Parade on Saturday.

Mayor Vorreiter congratulated Councilmember Miller on her election to the Board of National Women in Municipal Government.

Mayor Vorreiter congratulated the Department of Public Works for two awards recently received: a First Place Award from the Northern California Turf and Landscape Council for the landscaping completed at Wolfe and Evelyn; and the designation of a Class 8 rating for Sunnyvale in the Community Rating System (CRS) by the Federal Emergency Management Agency (FEMA).

Community Organization "Moment of Opportunity" Presentation:

Nancy Tibble of Sunnyvale Community Services presented her organization’s purpose and explained how people could help. She stated that the organization focuses on helping those in need, and that help was needed from volunteers as well as donations of large brown paper bags and hygiene kits. Sunnyvale Community Services is a non-profit public assistance agency formed to help families with meals and household necessities, and that their services to the City have increased in recent years. They are located at 810 W. McKinley Ave, phone number 738-4321.

Vice Mayor Walker moved, and Councilmember Miller seconded, approval of the Consent Calendar as presented. The motion carried unanimously.

Staff Recommendation: Approve Budget Modification #12.

Award of Bid F9910-39 for Police Patrol Sedans.

Staff Recommendation: Award a contract in the amount of $69,685 to Downtown Ford Sales of Sacramento for three police patrol sedans and authorize the Purchasing Officer to issue a purchase order to that effect.

RTC99-502

Approval of the Revised Memorandum of Agreement (MOA) for the Santa Clara Valley Urban Runoff Prevention Program, and Resolution to Apply for the Re-issuance of the Sunnyvale Municipal Storm Water National Pollutant Discharge Elimination System (NPDES) Permit.

Staff Recommendation: Sign the MOA for the City’s continued participation in the SCVURPP Program; and adopt the Resolution authorizing the City’s application for the re-issuance of the storm water NPDES permit as a co-permittee with other Santa Clara Water District communities.

Resolution No. 206-99: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE TO REAPPLY FOR REISSUANCE OF ITS MUNICIPAL STORMWATER NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT

PUBLIC HEARINGS/GENERAL BUSINESS

2. RTC99-504 Public Hearing on Study Issues and Budget Issues for Calendar Year 2000.

Assistant to the City Manager Dan Rich presented the staff report.

Mayor Vorreiter opened the public hearing at 7:55 p.m.

The following persons addressed the Council:

Jim Rea, 743 Madrone Ave., Vice Chair of the Parks and Recreation Commission, spoke in support of the five areas of concern to the Commission.

Jan Camp, President of the Board of Directors, Sunnyvale Historical Society, spoke in support of additional space for the Historical Society Museum.

Councilmember Roberts requested that the issue of space for the Historical Society Museum be added as a study issue.

Mark Stanek, 813 Allison Way, spoke in support of lowering golf course fees for Sunnyvale residents, and of giving residents priority in the use of golf greens.

Ginger Wolnik, Chair of the Sunnyvale Bicycle Committee, spoke in support of a code amendment in favor of bicyclists’ rights to drive-up access services, roundabouts at Bernardo and Knickerbocker, and the Mary Avenue overcrossing at the 280.

Mary Flanagan-Hanson, 624 Princeton Dr., Chair of the Sunnyvale Arts Commission, urged Council support of study issues regarding in-lieu fees for developers, pubic art in city building construction, and locational requirements of artwork in developments.

Suzy Blackman, President/CEO of the Sunnyvale Chamber of Commerce, stated the Chamber Board’s support of a 35% FAR, and related her support of a good relationship with the City.

Ray Montalvo, 895 Spinosa Dr., Chair of Legislative Committee of the Sunnyvale Chamber of Commerce, spoke regarding board and commission member eligibility and in support of space for the Historical Society Museum.

Barney Burke, Chair of Bicycle and Pedestrian Committee, spoke in support of bicycle amenities, traffic enforcement, and pedestrian safety.

Michelle Hornberger, Vice Chair, Sunnyvale Planning Commission, spoke in support of the Planning Commission’s list of ranked study issues and pocket parks.

Marshall Martin spoke in support of pocket parks.

Werner Gans, stated his support of regulations regarding large homes, his concerns about traffic in neighborhoods and cell phones used by drivers.

Bob Balmanno, 175 E. Olive Ave., Chapter Chair of SEIU, stated the need to improve communication between the part-time city employees’ union.

Thom Mayer, member of Bicycle Pedestrian Advisory Committee, spoke in support of parking enforcement and pedestrian safety.

Councilmember Roberts requested that the issue of using volunteers to help enforce disabled parking space regulations be added as a study issue.

Olivia Lin, representing the SEIU Local 715, spoke in support of communicating with Councilmembers during negotiations.

Councilmember Roberts requested a study issue on the matter of SEIU communications during negotiations.

Councilmember Miller requested a study issue regarding how to improve sidewalks and trees on South Murphy Street between El Camino and Iowa.

Mayor Vorreiter closed the public hearing at 9:10 p.m.

 

3. RTC99-512 Review of Sunnyvale Municipal Code Section 19.38.080 to Consider Modifications to the Requirements Related to Sidewalks in Industrial Areas.

Staff report presented by Trudi Ryan, Planning Officer.

Staff Recommendation: Adopt guidelines for a Comprehensive Sidewalk Program and include sidewalk funding in the forthcoming Transportation Capital Improvement Project.

Mayor Vorreiter opened the public testimony at 9:26 p.m.

Vice Mayor Walker moved, and Councilmember Miller seconded, to adopt alternatives 1 and 2 in the staff report (adopt guidelines for a Comprehensive Sidewalk Program and include sidewalk funding in the forthcoming Transportation Capital Improvement Project; and enact code changes to Sidewalks in Industrial Areas as found appropriate), with a modification to alternative 2 to look specifically at a cumulative threshold as well as lowering an in-lieu fee and including in Comprehensive Sidewalk Program. The motion carried unanimously.

Introduction of Ordinance: Establishing a Trial Period for Allowing those 18 Years of Age and Older in Pool and Billiard Halls.

Staff Recommendation: Enact an ordinance establishing a six-month trial period for allowing those 18 years of age or older in pool and billiard halls.

Supplemental Law Enforcement Funding Proposal and Continuation of Bureau of Justice Assistance Block Grant - Budget Modification No. 18.

Staff report presented by Pete Gonda of Public Safety.

Staff Recommendation: Approve Budget Modification No. 18, to appropriate the full amount available from LLEBG into the City’s LLEBG Sub-Fund, and approve the redirection of SLES and LLEBG funding.

Councilmember Fowler moved, and Councilmember Valerio seconded, approving the staff recommendation. The motion carried unanimously.

Changes to Title 2 of the Sunnyvale Municipal Code: Procurement and Contracting (Real Property, Goods & Services, and Public Works Contracting).

Staff report presented by Elaine Wesely, Purchasing Officer.

Staff Recommendation: 1.a. Add a new Chapter 2.07 entitled "Purchase, Sale or Lease of City Property;" 1.b. Repeal the existing Chapter 2.08 ("Purchasing System") and replace it with a new Chapter 2.08 entitled: Purchases of Goods and Services;" 1c. Add a new Chapter 2.09 entitled: Public Works Contracting."

Consideration of Retiring Energy Sub-Element.

Staff report presented by Trudi Ryan, Planning Officer.

Staff Recommendation: (1.) Adopt a Resolution to retire the Energy Sub-Element because adequate energy and cost conserving practices are now covered in most other city plans and policies. (2.) Create a new energy policy focused on current energy issues associated with the purchase, generation and distribution of power by/within the City as well as other issues in response to current State and Federal programs such as utility deregulation. This policy would not be a Sub-Element but a more flexible document that can be easily updated as the energy issues change.

Resolution No. 207-99: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING THE GENERAL PLAN BY RETIRING THE ENERGY SUBELEMENT

Councilmember Fowler moved, and Vice Mayor Walker seconded, to adopt the Resolution. The motion carried unanimously.

City Council Appointment to Santa Clara Valley Transportation Authority.

Staff Recommendation: Appoint a Councilmember to serve on the VTA Board.

Vice Mayor Walker moved, Councilmember Miller seconded, to appoint Councilmember Valerio to serve as a regular member of the VTA Board of Directors for a two-year term. The motion carried unanimously.

ADJOURNMENT TO CLOSED SESSION:

At 10:42 p.m., Mayor Vorreiter adjourned the meeting to a closed session in the West Conference Room of City Hall for Advisory Arbitration/SEA, pursuant to Government Code Section 54957.6.

The City Council reconvened in open session at 11:48 p.m. No action was taken in closed session.

Mayor Vorreiter declared the meeting adjourned at 11:48 p.m.
