SUNNYVALE CITY COUNCIL
FEBRUARY 8, 2000

 

The City Council of the City of Sunnyvale adjourned from a 6:30 p.m. Study Session regarding a Progress Report on Public Safety Committees, and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:30 p.m., with Mayor Vorreiter presiding.

SALUTE TO THE FLAG

The salute to the flag was led by Mayor Vorreiter.

SPECIAL ORDER OF THE DAY

Mayor Vorreiter recognized and thanked the two major contributors to the Columbia Neighborhood Center Health Fair held on January 22, 2000, Advanced Micro Devices (AMD) and Santa Clara Valley Health and Hospital System. Mayor Vorreiter presented certificates of appreciation to Grace Witt of AMD and to Rocio Abundis-Rodriguez, Site Manager of Columbia Neighborhood Center, who accepted the certificate on behalf of Marilyn Cornier of Santa Clara Valley Health and Hospital System.

PUBLIC ANNOUNCEMENTS

Margaret Lawson, Chair of Celebrate Sunnyvale 2000, presented a report of the group's activities, finances, and plans for future events. She stated that the next meeting of the Celebrate Sunnyvale 2000 committee will be held on March 1, 2000 at 6:00 p.m. at the Sunnyvale Elementary School District office on West Iowa.

Councilmember Fowler announced that Business Development Outlook magazine recently rated the City of Sunnyvale as "the most attractive American big city in which to operate a business" and rated the City No. 8 overall as "best place to live."

Mayor Vorreiter announced that she recently attended the Onizuka Air Force Station awards dinner and was impressed by the community involvement, commitment, and dedication of the award nominees.

Community Organization "Moment of Opportunity" Presentations:

Ray Montalvo, recent graduate of Leadership Sunnyvale, presented the organization’s purpose. Leadership Sunnyvale provides community and business leaders with tools for effective leadership in public affairs. The organization provides a nine-month training program to anyone wishing to participate, and the next class runs from September 2000 to June 2001. The group is in the process of becoming a non-profit organization. Interested individuals may contact Leadership Sunnyvale at 534-1118.

Bea Lopez, Executive Director, Social Advocates for Youth, presented the organization’s mission. The group advances the well-being of young people and their families by providing services that promote resiliency and teach self-respect, responsibility and healthy social interaction. The organization coordinates the Safe Place for children project, which currently involves 18 businesses that are trained to provide assistance to youth in crisis. Three other programs currently in place are the diversion program for first-time non-felony offenders, an anger management course for young people, and counselors for Columbia Middle School. Volunteers are welcomed, and more information may be obtained by calling Social Advocates for Youth at 253-3540.

Councilmember Miller moved, and Councilmember Roberts seconded, to approve the Consent Calendar as presented, with the exception of item 1H. The motion carried unanimously.

Authorization for City Manager to Execute Required Agreements for Pedestrian Improvement Project near Tasman West Light Rail Transit Project and Budget Modification No. 23

Staff Recommendation: Authorize the City Manager or his designee to execute required agreements for a TEA–21 Transportation Systems Operations grant for pedestrian Improvements near the Tasman West light rail transit corridor and a Wolfe Road traffic signal interconnect project; adopt Resolution; and approve Budget Modification No. 23 in the amount of $650,450.

Valley Transportation Plan 2020 Bicycle Element Project List (continued from the meeting of January 25, 2000)

Staff Recommendation: Approve the project list, certify that the City will commit a 20% local match for funded projects, and direct staff to forward the list to the Valley Transportation Authority for consideration in the development of the Valley Transportation Plan 2020 Bicycle Element.

Mayor Vorreiter noted that this item had been pulled from the agenda, and opened the public hearing at 7:57 p.m.

Thom Mayer, Bicycle Advisory Committee member, requested that six projects be added to the Bicycle Element Project List, as follows:

    1. Moffett Park Drive, west of Mathilda Avenue to the City limits;
    2. Maude Avenue between Fair Oaks Avenue and Mathilda Avenue;
    3. Sunnyvale Avenue from Central Expressway/Arques Avenue to Maude Avenue;
    4. California Avenue end to end;
    5. Old San Francisco Road from Fair Oaks Avenue to Sunnyvale Avenue;
    6. Fair Oaks Avenue from Evelyn Avenue to Old San Francisco Road; and
    7. Three of the four frontage roads that provide access to the Lawrence CalTrain Station: San Zeno Way, Lawrence Station Road, and Willow Avenue.

Traffic Engineer Raymond Williamson addressed the Council on this matter.

Mayor Vorreiter closed the public hearing at 8:04 p.m.

Councilmember Roberts moved, and Vice Mayor Walker seconded, to approve the staff recommendation with the addition of the seven projects requested by Thom Mayer. The motion carried unanimously.

PUBLIC HEARINGS/GENERAL BUSINESS

Application for a Use Permit to allow Demolition of an Existing Building, a Remodeling of an Existing Building and Construction of a 3-story Office Building with a Floor Area Ratio (FAR) of 50% where 35% is allowed without a Use Permit (1260 Crossman Avenue in an M-3 General Industrial Zoning District; Trinet Essential Facilities) Planning Commission continued item to February 28, 2000 – Continue to March 7, 2000

Vice Mayor Walker moved, and Councilmember Miller seconded, to continue the item to the meeting of March 7, 2000. The motion carried unanimously.

Application for a Special Development Permit to allow an Exterior Renovation to an Existing Office Building and an Increase of the Floor Area Ratio (FAR) to 47.4% where 35% is allowed without a Use Permit (1245 Oakmead Parkway in an M-2/PD Industrial and Service/Planned Development Zoning District; Ambex Venture Group, LLC [ARC TEC]) – Application withdrawn, no action required

No action was taken on this item.

Application for Use Permit to Allow Six New Office Buildings with a Floor Area Ratio (FAR) of 53.7% where 35% is allowed without a Use Permit (Southwest corner and Northwest corner of Mathilda Avenue and First Avenue in an M-3-General Industrial Zoning District; Sunnyvale Mathilda Land, LLC c/o Higgins Development Partners)

Senior Planner Gerri Caruso presented the staff report and responded to Council questions. Ms. Caruso noted three revised conditions of approval as follows:

16. An easement for access to the Bay Trail shall be provided on the site. The final alignment of the access route shall be determined by the Director of Parks and Recreation and the Director of Public Works.

17. The applicant shall provide $60,000 towards Bay Trail access improvements on the project site prior to issuance of a building permit.

31c. Provide safe bicycle and pedestrian routes to the Bay Trail access of a design to be approved by the Director of Public Works based on advice from the Bicycle Advisory Committee.

Planning Officer Trudi Ryan responded to Council questions.

Mayor Vorreiter opened the public hearing at 8:20 p.m.

Tom Prescott of Higgins Development Partners gave an overview of the project and responded to Council questions.

Tim Koogle, CEO of Yahoo! addressed the Council.

Wendy Hoyt of the Hoyt Company addressed the Council.

Barney Burke expressed his support of the project and recommended moving some of the bicycle lockers.

Aurora Garcia, Principal, Lester Shields Elementary School, expressed her support for the project, and related Yahoo!'s support of her school.

Suzi Blackman, President and CEO of the Chamber of Commerce, expressed her support of the project.

Joseph Rudnicki, Superintendent, Sunnyvale School District, expressed his support of the project, and related Yahoo!'s support of the school district.

Thom Mayer stated that the bicycle parking needed to be moved to a more accessible location, and requested handicapped van parking for Bay Trail access.

Yolanda Brown stated that the motion should be for five new office buildings and not six.

Planning Officer Trudi Ryan clarified that "six office buildings" was technically correct.

Mayor Vorreiter closed the public hearing at 9:05 p.m.

Councilmember Roberts moved, and Vice Mayor Walker seconded, to approve the application for a use permit with revised conditions as presented by staff (conditions 16, 17, and 31c). Vice Mayor Walker offered the following friendly amendments:

12c. At least six parking spaces for Bay Trail access, at least one of which must be handicapped van accessible.

13. The bicycle parking plan is to be reviewed by the Bicycle Advisory Committee prior to review by the Community Development Department.

The amendments were accepted by the maker of the motion (Councilmember Roberts).

Councilmember Miller offered the following friendly amendment:

16. The Bay Trail easement is to be recorded and identified as soon as possible.

City Attorney Armento addressed this matter.

The amendment was not accepted by the maker of the motion (Councilmember Roberts).

The motion, as amended, carried unanimously.

Request for Emergency Housing Consortium (EHC) for $1,425,000 in Community Development Block Grant Funds to Acquire an Existing Rental Housing Complex at 167 Acalanes Drive for the Provision of Affordable Housing and Budget Modification No. 22

Housing and Neighborhood Preservation Officer Dyane Matas presented the staff report and responded to Council questions.

Mayor Vorreiter opened the public hearing at 9:20 p.m.

The applicant, Ray Tovar, with the Emergency Housing Consortium, addressed the Council.

Tom Fair, owner of a neighboring property, expressed his concern with lack of information on the matter, and short amount of notice.

Paul Gallo, owner of a neighboring property, expressed his opposition to the project.

Robin Gallo, owner of a neighboring property, expressed his opposition to the project.

Fadi Semaan, owner of a neighboring property, expressed his opposition to the project.

Roland Felix, manager of a neighboring property, expressed his opposition to the project.

Barry Del Buono, Executive Director, Emergency Housing Consortium, offered to show other EHC properties to the concerned property owners.

Mayor Vorreiter closed the public hearing at 10:24 p.m.

Vice Mayor Walker moved, and Councilmember Miller seconded, to continue the matter for one week to allow time for the EHC to meet with property owners adjacent to the subject property. The motion carried unanimously.

Development and Administration of the Industrial Floor Area Ratio (FAR) Pool

Planning Officer Trudi Ryan presented the staff report and responded to Council questions.

Mayor Vorreiter opened and closed the public hearing at 10:41 p.m.

Councilmember Roberts moved, and Vice Mayor Walker seconded, to approve the staff recommendation to adopt the FAR Development Pool as described and subtract the total additional floor area above 35% from the pool, as recommended by the Planning Commission.

Councilmember Risch offered a friendly amendment to reexamine the policy when the pool becomes 80% depleted.

City Manager LaSala stated that staff could assess the matter and return to the Council with options regarding the question of what happens when the pool is almost depleted.

The friendly amendment was not acted upon.

The motion carried unanimously.

Boards and Commissions Recruitment Plan

Administrative Assistant and Volunteer Program Manager Sophie Horiuchi presented the staff report and responded to Council questions.

Mayor Vorreiter opened and closed the public hearing at 10:50 p.m.

Councilmember Miller moved, and Councilmember Valerio seconded, to approve the 2000 recruitment plan as submitted. The motion carried unanimously.

CITIZENS TO BE HEARD

Chris Rosenthal related problems with large trucks unloading cars near his townhome complex.

City Manager LaSala stated that Community Development and Public Safety would address the problem.

COUNCIL

Councilmember Fowler requested that the meeting be adjourned in memory of Russ Elliott, who served as coach of Lakewood youth baseball teams for many years, and passed away on Christmas Eve, 1999.
