MINUTES
SUNNYVALE CITY COUNCIL
MARCH 21, 2000

The City Council of the City of Sunnyvale adjourned from a 6:30 p.m. closed session regarding Real Estate Negotiations Regarding Disposition and Development Agreement for the Mozart Downtown Project, and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:30 p.m. with Mayor Vorreiter presiding.

Vice Mayor Walker announced that City Council met in closed session before the regular Council meeting, and that no action was taken but direction was given.

PUBLIC ANNOUNCEMENTS

Margaret Lawson, Chair of Celebrate Sunnyvale 2000, gave an update on recent activities and planned events, such as a timeline wall and tree planting at schools.

Margaret Maletis introduced three students from San Miguel School, who spoke regarding "Moments in Sunnyvale History."

Nicole Bailey, Carmen Talavera, and Jasmine LaBeau, students at San Miguel School, each presented information regarding the lifestyle of the Ohlone Indians, who were the first inhabitants of the Sunnyvale area.

Yolanda Brown, Chair of Census 2000 Committee, reminded everyone to complete their census forms, announced the arrival of the Census Bus at Sunnyvale City Hall on Tuesday, March 28, and gave Councilmembers census yard signs.

Colin Peterson spoke regarding the need for a youth bicycle jump park in Sunnyvale and requested information regarding how such activities could be conducted legally on water district property.

City Manager LaSala stated that Parks and Recreation staff would look into the matter and get back to Mr. Petersen.

Mayor Vorreiter announced that longtime Sunnyvale resident Teresa Zarevich, who resides at Manor Care, has just celebrated her 101st birthday, making her life span three centuries.

Councilmember Miller announced that she spent today as Principal for the Day at Columbia Middle School, and stated that she was proud of the accomplishments of the City, AMD, and the School District for the rewarding partnership at Columbia.

COMMUNITY ORGANIZATION "MOMENT OF OPPORTUNITY" PRESENTATION:

Joyce Miller of the Peninsula Chapter of Parents, Friends and Families of Lesbians and Gays (PFLAG), presented information regarding the founding of the organization in 1972 and its purpose. The group exists to promote equality, education, and enlightenment, and to create a healthy and respectful environment for lesbian, gay, and bisexual individuals and their family members. PFLAG worked actively in opposition to Proposition 22, and its members advocate at local, state, and federal levels. The PFLAG Sunnyvale help line is 270-8182. Regular PFLAG meetings are held as follows: Hillsdale United Methodist Church, 36th and Hacienda, San Mateo, 2nd Monday of the month at 7:30 p.m.; First Congregational Church, 1980 Hamilton Avenue at Leigh, San Jose, 2nd Wednesday of the month at 7:30 p.m.; St. Bede’s Episcopal Church, 2650 Sand Hill Road, Menlo Park, 3rd Thursday of the month at 7:30 p.m.; Kaiser Medical Offices, 7520 Arroyo Circle, Gilroy, 3rd Saturday of the month at 9:30 a.m.

City Manager LaSala requested that Item 1.F. be pulled from the Consent Calendar.

Vice Mayor Walker moved, and Councilmember Miller seconded, to approve the Consent Calendar as presented with the exception of Item 1.F. The motion carried unanimously.

Staff Recommendation: Award a contract in an amount not to exceed $180,550 to Motorola, Inc. of San Mateo to furnish and install workstations at the Department of Public Safety Dispatch Center.

Award of Contract for Engineering Consulting Services for Community Center and Library HVAC System Modifications (F9902-60)

 

Staff Recommendation: Award a contract in an amount not to exceed $73,447 to ESI Engineering Services, Inc., of Walnut Creek to provide professional evaluation and design services for Phase 1 of the Sunnyvale Community Center and Public Library Heating, Ventilating, and Air Conditioning (HVAC) Systems Modifications Project (Project PR-99/02-00)

Award of Bid for Landscape Maintenance Services (F9901-49)

 

Staff Recommendation: Award a two-year contract in an amount not to exceed $106,200 to TruGreen LandCare of Santa Clara to provide landscape maintenance services at the Water Pollution Control Plant and Landfill; and award a two-year contract in an amount not to exceed $93,280 to Environmental Care, Inc., of San Jose to provide landscape maintenance services at twelve water plants, five Hetch-Hetchy connections and six fire stations.

Award of Bid for the Installation of Slurry Seal Coat on Various Streets (ST-00/02-00)

 

Staff Recommendation: Award a contract in an amount not to exceed $233,624 (bid amount of $203,624 plus contingency of $30,000) to Bond Blacktop, Inc., of San Jose for the installation of slurry seal coat on various streets.

Resolution No. 120-00: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE ACCEPTING AS COMPLETED WORK FOR SAN ZENO WAY AND BLYTHE AVENUE SIDEWALK (ST-97/05-98), AUTHORIZING FINAL PAYMENT AND DIRECTING CITY CLERK TO FILE NOTICE OF COMPLETION

Authorization to "Piggyback" on Contract for Fire Trucks (F9903-63)

 

Staff Recommendation: Authorize the use of a contract initiated by the City of Eureka, Missouri, with American LaFrance Sales of Casper, Wyoming, for the purchase of two fire trucks in the amount of $1,153,560 for the Department of Public Works Fleet Maintenance Division.

City Manager LaSala commended the Purchasing Office for utilizing another jurisdiction’s contract, resulting in a savings of time and money for this purchase.

Mayor Vorreiter opened and closed the public hearing at 7:55 p.m.

Vice Mayor Walker moved, and Councilmember Valerio seconded, to approve the staff recommendation. The motion carried unanimously.

Resolution of Intention to Levy and Collect Assessment for the Downtown Parking Maintenance District for FY 2000/2001 and Approval of Preliminary Engineer’s Report

Finance Director Bradley presented the staff report and responded to Council questions.

Public Works Director Rose also responded to Council questions.

Mayor Vorreiter opened and closed the public hearing at 8:00 p.m.

Vice Mayor Walker moved, and Councilmember Roberts seconded, adoption of the Resolution of Intention; approval of the Preliminary Engineer’s Report (as amended, with the correction to the certificates page iii, substituting the name of the current Deputy City Clerk); the setting of the May 9, 2000 City Council meeting for the required public hearing; and authorization of the mailing of Notice of Proposed Assessment and ballots.

Resolution No. 121-00: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE DECLARING ITS INTENTION TO LEVY AND COLLECT AN ASSESSMENT FOR THE DOWNTOWN PARKING MAINTENANCE DISTRICT FOR FY 2000-2001

The motion carried unanimously.

Mayor Vorreiter opened and closed the public hearing at 8:04 p.m.

Vice Mayor Walker moved, and Councilmember Fowler seconded, adoption of the resolution.

Resolution No. 122-00: A RESOLUTION OF CONSIDERATION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE TO INCREASE THE ANNUAL APPROPRIATIONS LIMIT AND MAXIMUM AMOUNT OF BONDED INDEBTEDNESS, AND TO ALTER RATE AND METHOD OF APPORTIONMENT OF SPECIAL TAXES

Councilmember Fowler moved, and Councilmember Valerio seconded, adoption of the resolutions.

Resolution No. 123-00: A RESOLUTION OF INTENTION TO ESTABLISH A COMMUNITY FACILITIES DISTRICT – Community Facilities District No. 2

Resolution No. 124-00: A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE TO INCUR BONDED INDEBTEDNESS – Community Facilities District No. 2

The motion carried unanimously.

MOTION

Pre-Appeal of the Planning Commission Agenda of March 27, 2000 and the Administrative Hearing Agenda of March 29, 2000

No action taken was taken on this item.

CITIZENS TO BE HEARD

Thom Mayer questioned the ADA requirements for certain existing buildings in the downtown area adjacent to the parking garage.

Community Development Director Boesch responded that if the buildings were legally required to meet the ADA standards, that they would be updated.

Mr. Mayer continued that since he would not be in attendance at next week’s Council meeting when the Park Capacity and Use Analysis item would be considered, he would like to submit comments regarding this item. He then stated his concerns regarding the use capacity of Lakewood Park, which allows more picnic-goers than other parks in comparison with the number of parking spaces available. He further stated concerns with large corporate party picnic-goers blocking access to park amenities at Lakewood Park.

Vice Mayor Walker encouraged Mr. Mayer to obtain a copy of the report related to this item, and submit his comments in writing.

NON-AGENDA ITEMS & COMMENTS

 

COUNCIL

Councilmember Miller announced a Regional Noise Overflight Workshop on April 27 at 7:00 p.m. at the Palo Alto Arts Center in Palo Alto, and stated that similar meetings are being held throughout the Bay Area.

Councilmember Miller requested an update from staff on the enforcement of the noise ordinance, and related the types of leaf blower noise complaints she had received from citizens.

Councilmember Valerio announced that longtime resident Mark Stanek recently passed away. A Sunnyvale resident since 1973, Mr. Stanek devoted much of his time to the community in working to better the lives of the people of the Sunnyvale community. Councilmember Valerio stated that expressions of sympathy go out to the family.

Mayor Vorreiter announced the recent passing of Dorolou Pierson Swirsky, a longtime resident who had a special relationship with the City. In 1993, Ms. Swirsky established a living trust and directed that her estate be left to the City of Sunnyvale Youth Opportunity Fund. She was an avid lawn bowler and a longtime member of the Sunnyvale Historical Society. During her lifetime, Ms. Swirsky was recognized by numerous organizations for her gift and her example, and she will be missed by the Sunnyvale community. A memorial service will be held on Wednesday, March 29, at 1:30 p.m. in the Murphy Park Building, 230 E. California Street, Sunnyvale.
