MINUTES
SUNNYVALE CITY COUNCIL
MARCH 28, 2000
The City Council of the City of Sunnyvale adjourned from a 6:00 p.m. study session regarding a Review of the Code of Conduct for Elected Officials and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:30 p.m. with Mayor Vorreiter presiding.
SALUTE TO THE FLAG
The salute to the flag was led by Mayor Vorreiter.
SPECIAL ORDER OF THE DAY
Mayor Vorreiter introduced the Annual Fire Safety Poster Contest Awards Presentation. Public Safety Fire Prevention Officer Stephen Harrington, Public Safety Captain Chuck Eaneff, Kiwanis President Bill Barnes, Ian McMurray and Art Drummond of Kiwanis, and Mayor Vorreiter presented the awards to Sunnyvale school children who won the contest.

PUBLIC ANNOUNCEMENTS
Yolanda Brown, Chair of the Sunnyvale Census 2000 Committee, presented an update on recent census activities and gave Census 2000 t-shirts to City Councilmembers.
Mayor Vorreiter announced that Councilmember Miller was recently appointed to the Executive Committee of the Bay Area Air Quality Management District.
COMMUNITY ORGANIZATION "MOMENT OF OPPORTUNITY" PRESENTATION
:Lorraine Philips, Executive Director of the YWCA of the Mid-Peninsula, explained the role and purpose of the organization. The YWCA is dedicated to advancing the equality of women in society and eliminating racism. The organization has a child development center, a rape crisis center, and various classes and support groups. Interested individuals may contact the YWCA for more information at (650) 494-0972.

Vice Mayor Walker moved, and Councilmember Valerio seconded, approval of the Consent Calendar as presented. The motion carried unanimously.

Approval of the Workforce Investment Act Five-Year Plan for the NOVA Workforce Board, Including a Memorandum of Understanding between the City of Sunnyvale, the NOVA Workforce Board and the CONNECT! Partners |
Employment Development Director Curran presented the staff report.
Mayor Vorreiter opened and closed the public hearing at 7:56 p.m.
Councilmember Miller moved, and Councilmember Risch seconded, approval of the staff recommendations to concur with the NOVA Workforce Board and approve both the WIA Five-Year Plan and the Memorandum of Understanding between the CONNECT! partners, the NOVA WIB, and the Sunnyvale City Council as Chief Local Elected Official (CLEO); authorize the Mayor to sign both the Plan and the MOUs on behalf of the CLEO; and authorize staff to submit the Plan and the MOUs to the Governor no later than March 31, 2000. The motion carried unanimously.

Authority to Amend Membership of the Cities that Compose the North Valley Job Training Consortium |
Employment Development Director Curran presented the staff report.
Mayor Vorreiter opened and closed the public hearing at 8:05 p.m.
Councilmember Miller moved, and Councilmember Risch seconded, that the City, acting on behalf of the NOVA consortium cities, authorize the Mayor to request designation from the Governor of California for a seven city consortium (Cupertino, Los Altos, Milpitas, Mountain View, Palo Alto, Santa Clara and Sunnyvale) to serve as a Workforce Investment Area under the 1998 Workforce Investment Act. The motion carried unanimously.
Employment Development Director Curran announced that Joann Kleinman, Employment Training Manager, was retiring this week after 13 years with the Department, and commended her for her fine work.

Council Recognition Policy |
Senior Management Analyst/Deputy City Clerk Kelly presented the staff report.
Mayor Vorreiter opened and closed the public hearing at 8:10 p.m.
Vice Mayor Walker moved, and Councilmember Valerio seconded, adoption of the amended Legislative Policy on Council Recognition (Policy 7.3.9). The motion carried unanimously.

Park Capacity and Use Analysis – Study Issue |
Parks and Recreation Director Walker presented the staff report and responded to Council questions.
Mayor Vorreiter opened the public hearing at 8:25 p.m.
Richard Molina submitted a speaker’s card but was not present.
Ron Swegles, Chair, Parks and Recreation Commission, stated that the Commission voted in favor of the staff recommendations.
Pete Contostalvos of the Parks and Recreation Commission explained the intent of the study, the definition of park capacity, and stated that the Commission accepted staff’s assessment.
Mayor Vorreiter closed the public hearing at 8:33 p.m.
Vice Mayor Walker moved, and Councilmember Roberts seconded, to adopt the conclusions presented in the staff report; accept that Sunnyvale’s public parks are not, in general, taxed beyond capacity; direct staff to take no further action to mitigate park capacity issues; and encourage staff to continue working with park users and Sunnyvale residents living adjacent to public parks to resolve "good neighbor" issues through operational and administrative means. The motion carried unanimously.
City Manager LaSala commended staff and the Parks and Recreation Commission for working together on this issue and arriving at a well-researched set of recommendations.

Appeal of the Administrative Hearing Agenda of March 15, 2000 |
No action was taken on this item.
CITIZENS TO BE HEARD
Mitchell Loebel presented an update on the appeals hearing for the sanitary sewer system problem at 1066 Sunnyvale-Saratoga Road, and thanked the City Council and staff for helping to bring this matter to a conclusion.
Steve Hawkins, on behalf of the plaintiffs and other tenants, thanked the Council for its support on the resolution of the sanitary sewer system issue.
NON-AGENDA ITEMS & COMMENTS
COUNCIL
Councilmember Valerio reminded everyone that the memorial service for Dorolou Pierson Swirsky will be held on Wednesday, March 29, at 1:30 p.m. in the Murphy Park Building, 230 E. California Street, Sunnyvale. Ms. Swirsky bequeathed her estate to the City of Sunnyvale.
Councilmember Risch thanked the Council and staff for their support at the recent National League of Cities’ (NLC) Conference.
Councilmember Valerio thanked Public Works staff for their response to a recent water main break at his condo complex. He commended staff on a job well done.
