Approval is requested for the award of a contract to AQUA-Science of Davis to furnish and install a custom trailer-loaded bioassay laboratory for the Water Pollution Control Plant (WPCP).

The WPCP has been notified by the California State Department of Health Services that it must upgrade its existing bioassay system as part of the recertification of the laboratory facility. The upgrades mandated by the State are so extensive that the most cost effective approach is to replace the entire system. The upgrade deadline imposed by the State requires the City to act quickly if the WPCP laboratory is to remain certified.

AQUA-Science manufactures custom, self-contained bioassay and culture systems housed in a mobile trailer. All plumbing, electrical, HVAC, lighting, and mechanical equipment as well as laboratory furniture are included in the self-contained unit which can be delivered by AQUA-Science within sixty days of order.

Staff has determined that purchasing such a unit is the best available option for meeting State requirements by the specified deadline.

Section 2.08.070 (b) of the Sunnyvale Municipal Code provides for exceptions to competitive bidding requirements in situations where the solicitation of bids would for any reason be impractical, unavailing or impossible. In this case, the City will be unable to meet the State’s laboratory upgrade deadline if staff takes the time to develop specifications and solicit competitive bids.

Total cost to the City will not exceed $80,741. This cost can be broken down as follows:

Funds are available in Capital Project Account #801150-5430.

It is recommended that Council award a contract in an amount not to exceed $80,714 to AQUA-Science of Davis to furnish and install a custom, trailer- loaded bioassay laboratory for the Water Pollution Control Plant.
