SUBJECT: Recommendation to Sunnyvale City Council to Approve the Resolution Authorizing Acceptance of Subgrants and Agreements Funded by the Workforce Investment Act and Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids, and Authorizing Execution of Documents

EXECUTIVE SUMMARY

On March 29, 1988, the Sunnyvale City Council approved Resolution No. 123-88, authorizing acceptance of subgrants and agreements funded by the Job Training Partnership Act, and authorizing execution of documents. The Job Training Partnership Act sunsetted June 30, 2000 and was replaced by the Workforce Investment Act.

In January 2000, the Sunnyvale City Council approved the recommendation from NOVA staff to implement the Workforce Investment Act of 1998 (WIA), which included agreement to serve as the Chief Local Elected Official (CLEO), with the City of Sunnyvale acting as the administrative/fiscal entity for NOVA programs (RTC#00-012). In July 1998, the Sunnyvale City Council authorized the submission of a three-year Welfare to Work plan for Santa Clara County (RTC#98-244).

As the Job Training Partnership Act has sunsetted and was replaced by the Workforce Investment Act effective July 1, 2000, a new resolution has been developed and is being submitted to the City Council for approval which provides the same authorization under WIA, as existed with the Job Training Partnership Act. This resolution also includes authorization for welfare-to-work subgrants and agreements.

BACKGROUND/DISCUSSION

Since 1988, under the Job Training Partnership Act, the State has required that each Service Delivery Area have on file with the State, documentation regarding their signatory authority to enter into agreements with the State and accept funding, accordingly. The NOVA Consortium, designated as a Service Delivery Area, with the City of Sunnyvale acting as the administrative/fiscal agent for this Consortium, complied with this requirement approving Resolution # 123-88.

Under the Workforce Investment Act, the State requires that each Workforce Investment Area have on file with the State similar signatory documentation, as existed under the Job Training Partnership Act. As the NOVA Consortium of seven cities has been designated a Workforce Investment Area and the City of Sunnyvale is again acting as the administrative/fiscal agent for this Consortium, a new resolution has been developed for City Council approval.

This new resolution has also expanded upon the former resolution to include welfare-to-work agreements and subgrants, as NOVA has become a significant provider in this program area and recipient of funding, for the past several years.

EXISTING POLICY

The proposed activities are consistent with the City of Sunnyvale's Socio-Economic Goal 5.1F: Provide job training and employment services within constraints of operative Federal regulations and available Federal funding to address the locally-determined employment and training needs of economically disadvantaged residents and others with special needs.

FISCAL IMPACT

With this approved resolution, the City of Sunnyvale will be able to enter into agreements with the State under the Workforce Investment Act and the Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids, and accept funding, accordingly.

ALTERNATIVE

Without an approved Resolution, the City of Sunnyvale will be unable to receive funding from the State.

RECOMMENDATION

Staff recommends that the Sunnyvale City Council approves the attached Resolution authorizing acceptance of subgrants and agreements fund by the Workforce Investment Act and Personal Responsibility and Work Opportunity Reconciliation Act/California Work Opportunity and Responsibility to Kids, and authorizing execution of documents.
