SUNNYVALE CITY COUNCIL

SEPTEMBER 12, 2000

The City Council of the City of Sunnyvale met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:30 p.m. with Mayor Vorreiter presiding.

PUBLIC ANNOUNCEMENTS

Jim Telfer, Executive Director of Leadership Sunnyvale, stated that the new Leadership class started last week, and thanked the Council for making Sunnyvale Leadership Development Institute a co-sponsored group.

Councilmember Fowler made announcements on behalf of the City Council. He announced that in order to gather public input, two meetings to discuss potential changes to single family development regulations have been scheduled by the City. The first was held last Thursday and the second will be tomorrow night. Members of the public who are not able to attend the meeting may offer comments by calling 730-7440 or sending an e-mail to planning@ci.sunnyvale.ca.us.

Councilmember Fowler also announced the City’s First Annual International Street Faire which will be held on September 23rd from 11:00 a.m. to 4:00 p.m. on West Olive Avenue in front of the Library.

He further announced that the City will be holding two forums on Measure "S", the ballot measure regarding accepting fluoridated water from suppliers, on September 22 and October 19, both at 7:00 p.m. in the City Council Chambers.

Mayor Vorreiter announced that the City Attorney was recently elected Second Vice-President of the City Attorneys’ Division of the League of California Cities.

COMMUNITY ORGANIZATION "MOMENT OF OPPORTUNITY" PRESENTATION

Gayla Hibbert, Coordinator, Library Information Learning Services, Fremont Union High School District, presented an overview of the District’s libraries and their services. The libraries serve the District’s 9,000 students and there are plans to build three new libraries. The libraries give students the resources and tools to do research. In addition, the District is working with the Sunnyvale Library on sharing collections.

Marilyn Roaf, a City employee, requested that Item 1.G. be pulled from the Consent Calendar.

Vice Mayor Walker moved, and Councilmember Miller seconded, approval of the Consent Calendar with the exception of item 1.G. The motion carried unanimously.

Staff Recommendation: Approve Budget Modification No. 5 to reflect unanticipated increased grant revenues and related expenditures for the Transportation Development Act Bicycle and Pedestrian Project.

Amendment to the Classification Plan and Salary Resolution: Housing and Neighborhood Preservation Supervisor

Staff Recommendation: Approve inclusion of the new classification into the City’s Classification Plan and Salary Resolution.

Chuck Schwabe, Acting Human Resources Director, presented the staff report and responded to Council questions.

Mayor Vorreiter opened the public hearing at 7:45 p.m.

Marilyn Roaf, City employee, Community Development Department, stated that the creation of this position appears to circumvent a grievance that has been filed, and that she would prefer the opportunity for SEA to discuss the position with management prior to Council action.

City Attorney Armento clarified that the position would become part of the classification plan until deleted.

Acting Community Development Director Rose addressed Council questions on the position.

Doug Spinelli, City employee, Community Development Department, stated that positions should be filled through an open, competitive process, and that the process of creating this position was circumventing the established process.

Mayor Vorreiter closed the public hearing at 8:10 p.m.

Vice Mayor Walker moved, and Councilmember Miller seconded, adoption of the resolutions. The motion carried unanimously.

Resolution No. 182-00: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING THE CLASSIFICATION PLAN OF THE CIVIL SERVICE BY CREATING THE JOB CLASSIFICATION TITLE OF HOUSING AND NEIGHBORHOOD PRESERVATION SUPERVISOR AND BY ADDING THE CLASSIFICATION SPECIFICATIONS THEREFOR

Investment and Cash Management Policy Update for FY 2000/2001

Finance Manager Balbo presented the staff report and responded to Council questions.

Mayor Vorreiter opened and closed the public hearing at 8:19 p.m.

Councilmember Roberts moved, and Councilmember Fowler seconded, adoption of the Investment Policy as presented by staff. The motion carried unanimously.

Mary Avenue Bicycle/Pedestrian Overcrossing of Route 280 – Study Issue

Sr. Transportation Planner Witthaus presented the staff report and responded to Council questions.

Mayor Vorreiter opened the public hearing at 8:50 p.m.

Ronald Singletary, Laurentian Way, showed where he lives with respect to the proposed bridge, and stated his concerns with privacy in his backyard and jurisdictional issues.

Bud Kundich, Laurentian Way, stated his concerns with the lack of solicitation of citizen participation by the VTA, that the right of way property needed to be maintained and that he was concerned with undesirables having access to the area.

James Paul, Laurentian Way, stated that the report was thorough and fair, and that the school entrance issue was not considered by the City of Cupertino.

Councilmember Risch requested Mr. Paul’s phone number in order to coordinate a meeting in the area.

Kevin Jackson, Fraser Drive, stated that this was one of several potential projects submitted to the VTA to promote non-motorized transport, and that it would provide improved safety and convenience for pedestrians and bicyclists.

Fred Wiesinger, Chair, Sunnyvale Bicycle Advisory Committee, stated that the concerns expressed were not insurmountable, and that the project fits well with Sunnyvale’s policies on alternative transportation.

David Simons, Mary Avenue, related the history of the project, and explained his involvement with committees that discussed this matter. He stated that the project was voted No. 1 in the County list of priorities by the County Bicycle Advisory Committee.

Thom Mayer stated that since Route 280 is depressed, that the design can be lower over the highway, and that there has been a lot of citizen involvement in this process. He requested that the Council support alternatives 1, 2, 3, and 4 in the staff report.

Mayor Vorreiter closed the public hearing at 9:20 p.m.

Councilmember Valerio moved, and Councilmember Fowler seconded, approval of the staff recommendation as follows (alternatives 1, 2, and 3): (1) direct City staff to actively participate and influence the planning and design process for the bridge proposal to assure that the concerns of Sunnyvale residents are addressed; correspondence received and issues identified should be transmitted to the City of Cupertino to be included in their current public outreach and decision making process; Sunnyvale should also request that the City of Cupertino notify concerned Sunnyvale residents of any and all public participation opportunities associated with this proposal; (2) direct staff to return to Council to consider financial participation in a project if funding by Sunnyvale will result in improvements to the project that address Sunnyvale resident’s concerns; and (3) direct staff to give the Bicycle Advisory Committee and the City Council the opportunity to comment on the environmental document for a project. The motion carried unanimously.

Mayor Vorreiter suggested that, as the project moves ahead, the City should have input on long-term maintenance issues.

No action was taken on this item.

CITIZENS TO BE HEARD

Thom Mayer stated that he has interacted with the new provisional Housing and Neighborhood Preservation Supervisor and that he was pleased.

NON-AGENDA ITEMS & COMMENTS

COUNCIL

Councilmember Miller thanked citizens who had written to her on code enforcement issues, and gave the City Manager an e-mail she received from a constituent wanting a response on a rent control question.

Mayor Vorreiter declared the meeting adjourned to the Redevelopment Agency at 9:28 p.m.
