MINUTES
SUNNYVALE CITY COUNCIL
APRIL 17, 2001

The City Council of the City of Sunnyvale adjourned from a 6:30 p.m. Study Session regarding Emergency Preparedness Management Training and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California, at 7:30 p.m. with Mayor Walker presiding.

PUBLIC ANNOUNCEMENTS

 

Joe Ribera, announced the Annual Sunnyvale Family Health and Safety Fair that will take place at the Columbia Neighborhood Center on Saturday, April 28, from 11:00 a.m. to 3:00 p.m.

Jerry Nabhan, Sunnyvale Rotary Club, announced a Mother’s Day rose sale to support local youth programs. One dozen long stem boxed roses will cost $25.00 and orders must be placed and paid for by April 30. Orders can be placed by contacting Vice Mayor Fowler, Councilmember Vorreiter, Jerry Nabhan at Specialty Solid Waste 566-1809,

Benny Nelson 248-2429, Marie Kuykendall 730-5044, or Bob Lawson 830-9191.

Councilmember Vorreiter welcomed new Sunnyvale SUN reporter Gretchen Knaup.

Councilmember Miller moved and Councilmember Vorreiter seconded, approval of the consent calendar. The motion carried unanimously.

Staff Recommendation: Award a contract in the amount of $92,633 to U.S. Traffic Corporation of Dublin to furnish traffic signal controller equipment.

Staff Recommendation: Award a contract in the amount of $103,728 to Kurtt International Trucks of San Jose for one cab/chassis with sewer flushing machine.

Authorization to Renew a Contract with the State of California for $126,127 to Conduct the 2001 Labor Market Information Study for Santa Clara and San Mateo Counties

Staff Recommendation: Authorize to renew a contract with the State of California for $126,127 to conduct the 2001 Labor Market Information studies for Santa Clara and San Mateo Counties, and authorizes the City Manager to negotiate and enter into the contract.

Mayor Walker opened and closed the public hearing at 7:41 p.m.

Councilmember Valerio moved and Councilmember Miller seconded, to continue the related applications to May 15, 2001 as requested by the applicant. The motion carried unanimously.

Mayor Walker stated that Item No. 4 would be taken out of order.

Appeal of a Decision by the Planning Commission Approving the Special Development Permit to Allow the Installation of Façade Mounted Wireless Telecommunications Antennas and Associated Equipment; Application for a 5,997 Site Located at 1300 Cheasapeake Terrace in a M-S/PD (Industrial Service/ Planned Development) Zoning District (Negative Declaration) - Benjamin A. Davies (Sprint PCS) (Applicant)

Mayor Walker announced that the Applicant has requested to continue this item to May 1, 2001.

Mayor Walker opened and closed the public hearing at 7:43 p.m.

Councilmember Vorreiter moved and Councilmember Miller seconded, to continue this item to the City Council meeting of May 1, 2001. The motion carried unanimously.

MOTION
RTC 01-116

Application for a 36,802 Square Foot Site Located at 1274 Anvilwood Avenue in a M-S (Industrial Service) Zoning District, Use Permit to Allow a Floor Area Ratio (FAR) of 46% where 35% is Allowed without a Use Permit (Negative Declaration) - Kevin Mattos (Applicant) James/Julie Hall (Owners)

Project Planner Jones presented the staff report and responded to Council questions. Community Development Director Paternoster also responded to Council questions.

Mayor Walker opened the public hearing at 7:51 p.m.

Kevin Mattos, Project Architect, was available to answer Council questions and encouraged Council support for the project.

Mayor Walker closed the public hearing at 7:54 p.m.

Councilmember Vorreiter moved and Councilmember Risch seconded, to adopt the Negative Declaration and approve the Use Permit application with modifications approved by the Planning Commission.

Mayor Walker offered a friendly amendment to require a Traffic Demand Management Program.

Councilmember Vorreiter did not accept the friendly amendment.

Mayor Walker moved and Councilmember Miller seconded, to require a Traffic Demand Management Program.

Mayor Walker withdrew his motion.

Councilmember Vorreiter amended the main motion and was accepted by the seconder of the motion, to include a requirement for a Traffic Demand Management Program with a minimum of 10% reduction.

The motion as amended carried unanimously.

ORDINANCE
RTC 01-104

Amendments to Chapter 12.04 Sewerage System, Chapter 12.12 Sewer Use Regulations and Chapter 12.16 Wastewater Charges and Fees in Title 12 of the Sunnyvale Municipal Code

Environmental Division Manager Gervin presented the staff report and provided Council with copies of the Ordinance noting the proposed changes. Public Works Director Rose was also available to respond to Council questions.

Mayor Walker opened and closed the public hearing at 8:10 p.m.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING CHAPTERS 12.04, 12.12 AND 12.16 OF THE SUNNYVALE MUNICIPAL CODE PERTAINING TO THE SEWERAGE SYSTEM, SEWER USE REGULATIONS AND WASTEWATER CHARGES AND FEES

Councilmember Vorreiter moved and Councilmember Valerio seconded, first reading of the ordinance as presented.

The motion carried by the following roll call vote:

NON-AGENDA ITEMS & COMMENTS

COUNCIL

Councilmember Miller announced that on Saturday, April 28, beginning at 8:00 a.m. Black & Decker, the Bay Area Air Quality Management District and the Santa Clara County Solid Waste Commission are co-sponsoring a lawn mower buy-back program at the Sunnyvale Home Depot where gasoline lawn movers can be turned in and electric mowers can be purchased at a discount.

Councilmember Vorreiter announced on behalf of the City Council that Mayor Walker has received a congratulatory letter from the State of California Environmental Protection Agency in recognition of the City’s innovative waste reduction programs. The letter cited the City’s outstanding waste reduction efforts and the Citywide Garage Sale as examples of programs to divert usable materials from going to the landfill and as a way to meet mandates of the Integrated Waste Management Act. She further announced the dates of this year’s Citywide Garage Sale are May 5 and 6.

Councilmember Valerio announced that the road smoothing work on the railroad crossings at Sunnyvale Avenue and Mary Avenue was completed and asked staff if corrective work to the sidewalks and street re-striping was also scheduled. He also thanked City staff for their support with this project.

STAFF

Public Works Director Rose announced that the deadline for submitting applications for the Citywide Garage Sale had passed but information is available by calling 730-7415.

Public Works Director Rose stated that pavement, concrete and street re-striping work in the area of the railroad crossings on Sunnyvale Avenue and Mary Avenue is planned.
