MINUTES
SUNNYVALE CITY COUNCIL
OCTOBER 16, 2001
7:30 P.M.

The City Council of the City of Sunnyvale adjourned from a 6:00 p.m. Closed Session on Potential Litigation Regarding Water Quality Matters, Government Code Section 54956.9 and a 6:30 p.m. Joint Study Session, with the Bicycle and Pedestrian Advisory Committee regarding Mathilda Avenue/Caltrain Bridge Improvement, and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California at 7:30 p.m. with Mayor Walker presiding.

PUBLIC ANNOUNCEMENTS

 

Michael Flores announced a website for information regarding candidate forums.

Michael Goulash announced that a monthly meeting of the Heritage District Neighborhood Association would be held on Wednesday, October 17, 2001, at 7:30 p.m., at Murphy Park.

Councilmember Vorreiter announced the Creative Arts Center Pottery Program and the Department of Parks & Recreation will be hosting a pottery sale this Friday and Saturday, October 19 and 20, at the Community Center, 550 E. Remington Drive, from 9:00 a.m. to 4:00 p.m. Part of the proceeds will benefit the Pottery Studio and its 300 students who participate in this Parks & Recreation program. For more information, call 730-7624. She also announced that a walk to benefit Domestic Violence Awareness would be held in San Jose on Friday, October 19, 2001, from 8:30 a.m. to noon. Participants should meet at the San Jose Convention Center, 801 North First Street.

Vice Mayor announced that no action was taken during the closed session.

CONSENT CALENDAR

Tom Dwyer, a member of the audience, requested that item 1A be pulled from the consent calendar. Vice Fowler moved, and Councilmember Miller seconded, approval of the consent calendar, with the exception of item 1A. The motion carried unanimously.

Approval of Draft Minutes (October 9, 2001)

Motion by Vice Mayor Fowler, seconded by Councilmember Miller, to approve the minutes as amended. The motion carried unanimously.

Staff Recommendation: Approve an agreement with LeBeoeuf, Lamb, Greene & MacRae, L.L.P. for Robert Thompson's environmental legal services in an amount not to exceed $175,000.

Staff Recommendation: Establish the Police Service Augmentation Fund and its two (2) sub-funds, and approve Budget Modification No. 9.

Staff Recommendation: Adopt Resolution No. 198-01, setting a public hearing to Consider Preliminary Determination and Intention to Establish the Hollenbeck Road Underground Utility District.

Pre-Appeal of the Planning Commission Hearing of October 22 and the Administrative Hearing of October 24, 2001.

No action was taken.

CITIZENS TO BE HEARD

Michael Goulash addressed comments to the Council regarding the Wyant and Smith Crematorium project.

Community Development Director gave assurances that the project meets the legal requirements.

Michael Flores commented on the candidate's forum that was hosted by the League of Women Voters and Chamber of Commerce.

Glen Treiber addressed the Council with concerns about the mulch that is available at the SMaRT Station.

Jack Robertson conveyed his distress apropos noise emanating from the water treatment plant.

NON-AGENDA ITEMS & COMMENTS

COUNCIL

Councilmember Valerio inquired about code enforcement actions that can legally be taken without violating private property rights.

Councilmember Miller queried what the process is for changing a street name. City Attorney Armento will brief Councilmember Miller on the specific process. She announced that a joint meeting of Bay Area Air Quality Management District (BAAQMD), Association of Bay Area Governments (ABAG), and Metropolitan Transportation Commission to discuss the Clean Air Plan for 2002 will take place on October 24, 2001, at 9:30 a.m. at the ABAG center in Oakland. She noted that support of the plan affects the city's ability to obtain transportation funding. She urged that the city send a letter in support of the passage of this plan.

ADJOURNMENT TO REDEVELOPMENT AGENGY

Mayor Walker declared the meeting adjourned to the Redevelopment Agency Meeting at 8:19 p.m. and the Redevelopment Agency adjourned to a Closed Session at 8:24 p.m.

ADJOURNMENT

After adjourning the Closed Session regarding Labor Negotiations with the Public Safety Officers Association (PSOA), Mayor Walker declared the regular meeting of the City Council adjourned at 9:43 p.m.
