SUNNYVALE CITY COUNCIL
NOVEMBER 27, 2001
7:30 P.M.
The City Council of the City of Sunnyvale adjourned from a 6:00 p.m. Study Session regarding the Moffett Park Specific Plan and a 7:00 p.m. Study Session regarding the National League of Cities Conference Preparations and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California at 7:30 p.m. with Mayor Fowler presiding.

SPECIAL ORDER OF THE DAY:
Recognition of Red Ribbon Week Poster WinnersMayor Fowler introduced BC Gibbons, of the Sunnyvale School District, and Peter Smith, of the Kiwanis Club, to the podium to present awards to the winning students. Belinda Cuersema, Fairwood School, Andrea Vera, SanMiguel School, Sydney Shiroyama, Ellis School, and Milada Belohlavek, Sunnyvale Middle School, each received a United States Savings Bond and certificate.
Mayor Fowler congratulated the students and thanked the Sunnyvale Kiwanis Club for their continued support of the program.
PUBLIC ANNOUNCEMENTS
John Mayer announced that the Lakewood Village Christmas Parade will be held on December 8, 2001, beginning at 11:00 a.m. and commencing at Fairwood Elementary School.
Suzi Blackman, President and CEO of the Sunnyvale Chamber of Commerce, extended an invitation to the Second Annual Christmas Tree Lighting that will take place on November 28, 2001, from 6:00 p.m. to 8:00 p.m., on Murphy Avenue. She further announced that the Chamber Auction would be held on November 29, 2001, from 5:00 p.m., at the Washington Park Community Center.
Vice Mayor Miller made the following announcements:
The City of Sunnyvale has launched some new services to help community groups hold successful events within the City. These services include possible grant funding to cover some of their event costs, use of the City’s banner locations, if available, to promote events, and working with staff to determine if City assistance is available or if permits are required. The application period for grant funding opened this Monday, Nov. 26, and closes Jan. 25, so groups are strongly encouraged to apply now! The application is available on the city's website or by calling the Deputy Communications Officer at 730-7575.
Tomorrow evening at 6:30 p.m. residents are invited to join the Council and downtown merchants as the Mayor lights the downtown Christmas tree, which will be located on Murphy Avenue. There will be free hot cider and carolers, and Santa will be there for pictures with your children. Come join the festivities as the downtown merchants kick off the holiday season.
In the next two weeks, the City will once again conduct a Citizen Opinion and Satisfaction Survey to obtain feedback from residents to help guide the City in providing service to our citizens. Households will be randomly selected to participate in the survey. If you receive a survey, you will be asked to respond by calling an 800 number to record your responses. Questions will reflect a variety of topics relevant to quality of life in Sunnyvale, such as traffic, housing, and public safety. Results of the survey will be made public next spring. If you have any questions, please call 730-7473.
A public forum will be held on Thursday, December 6 from 6:30 to 8:30 p.m. to obtain input on the Downtown Urban Design Study. The public is invited to attend the forum to give input to the study, which will shape the design of downtown development in Sunnyvale. The forum will be held in the Arboretum at the Sunnyvale Community Center, 550 East Remington Drive.
In conclusion, the regularly scheduled Council meeting for next Tuesday evening, December 4, has been re-scheduled to Monday, December 17, at 5:00 p.m.

Vice Mayor Miller, moved, and Councilmember Valerio seconded, approval of the consent calendar. The motion carried unanimously.

Public Hearing on Potential Council Study Issues

City Clerk Kitchens presented the staff report. Mayor Fowler opened the Public Hearing at 7:53 p.m. Ron Swegles requested a Study Issue on Mobile Home Park Traffic Enforcement. Councilmember Risch and Vice Mayor Miller agreed to co-sponsor the issue. Fred Wiesinger, Bicycle and Pedestrian Advisory Committee, would like broader notification of the Public Hearing. He shared the Committee's study issue priorities, which included Mary Avenue Bike Lanes, Review of Municipal Code Relating to Bicycles and Pedestrians, State of Cycling in Sunnyvale, Pedestrian Safety and Public Awareness. Werner Gans expressed disappointment in several Moffett Park buildings and suggested an Architectural Advisory Board to review the building designs. He also would like campaign contributions and traffic calming studied. Councilmember Walker sponsored Study Issues on forming an Architectural Advisory Board and Light Rail Alignment through Sunnyvale. Michael Goulash expressed support for the Review of Residential Density in the Downtown Area East of Carroll Street, the matter of Grandfathering Use Permits, and would like other vehicles for community outreach explored. Councilmember Risch sponsored the Grandfathering Use Permits Issue and Vice Mayor Miller co-sponsored Vehicles for Community Outreach, in particular, the city's website. Vice Mayor Miller sponsored Review of Residential Density in the Downtown Area East of Carroll Street taking the surrounding area into account, and Improving Communications on the City's website and KSUN. Yolanda Brown, Planning Commission Chairman, reviewed the rankings of the Planning Commission. These included Energy Regulations, including building policies and guidelines, Clarify CEQA Requirements in Relation to the Heritage Preservation Code, Privacy Issues Between Residential and Non-residential Developments and Zoning Districts, TDM Monitoring and Audits, Synergy between Mass Transit Facilities and FAR Intensity, and Upgrading Covered Parking Concurrently with Single Family Additions or Reconstruction. Joseph Detmer supported Review of Residential Density in the Downtown Area East of Carroll Street. Tommy Carrig also supported Review of Residential Density in the Downtown Area East of Carroll Street. He noted the impacts from trains in the downtown area and bus emissions. Councilmember Valerio responded to the emissions comments and noted measures being taken to improve air quality. Micki Falk noted the impact of school traffic that was promulgated by The Partnership Concept with the Cupertino Union School District. Staff was directed to review the matter and prepare an RTC regarding these traffic impacts. Donna Carrig supported Review of Residential Density in the Downtown Area East of Carroll Street. Mayor Fowler closed the Public Hearing at 8:49 p.m. |

Peter Gonda, Management Analyst, presented the staff report. Mayor Fowler opened the Public Hearing at 8:54 p.m. Werner Gans inquired whether the tax is applied to cell phones. Finance Director Bradley responded that cell phones are included in remittances. Mayor Fowler closed the Public Hearing at 8:56 p.m. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING CHAPTER 3.12 OF THE SUNNYVALE MUNICIPAL CODE PERTAINING TO THE UTILITY USERS TAX Councilmember Valerio moved, and Councilmember Vorreiter seconded approving the introduction of the Ordinance amending Chapter 3.12 of the Sunnyvale Municipal Code. The motion carried unanimously. |

Katherine Chappelear, Youth and Family Services Manager, presented the staff report. Vice Mayor Miller moved, and Councilmember Risch seconded approving the positions as recommended by staff with one change to reflect support of CED6 regarding Federal Disaster Assistance reimbursement of expenses by FEMA. The motion carried unanimously. |

Mayor Fowler adjourned the regular meeting to a Closed Session at 9:25 p.m.

After adjourning the Closed Session regarding Labor Negotiations with the Public Safety Officers Association (PSOA), Mayor Fowler declared the regular meeting of the City Council adjourned at 10:25 p.m.
