SUNNYVALE CITY COUNCIL
JANUARY 8, 2002

The City Council of the City of Sunnyvale adjourned from a 6:00 p.m. Study Session regarding Future Fiscal Issues, and a 7:00 p.m. Study Session regarding the Review of Year End Report and Budget Modifications, and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California at 7:30 p.m. with Mayor Fowler presiding.

Vice Mayor Miller moved, and Councilmember Vorreiter seconded, approval of the consent calendar with the exception of item 1.A. The motion carried unanimously.

RTC 02-004 |
City of Sunnyvale: Housing & Community Revitalization Sub-element |

Shetal Divatia, Project Planner, presented the staff report. Irisann Nelson, Housing and Human Services Commission Chairman, stated that over the last eighteen months the Commission had identified 30 issues and had outlined housing goals. The working groups had also discussed regional housing issues and the impacts that increased housing brings. Yolanda Brown, Planning Commission Chairman, noted that the working groups were very effective. She noted modifications to the action statement that the Planning Commission had made. She expressed concern about the census data was outdated and the 2000 census figures should be included in the report when they are released by the Federal Government. She would like for the tables to be updated when new figures are received to reflect current information. In response to Councilmember Howe's query, Planning Officer Ryan responded that new census data would be added on an annual basis. Chris Moylan, Planning Commissioner, noted that the Socio-Economic Sub-element needs to be updated as it contains outdated information. Councilmember Vorreiter requested that the Socio-Economic Sub-element be considered as a Study Issue for 2003. Councilmember Howe moved, and Vice Mayor Miller seconded, approval of the Negative Declaration, adopted the Housing and Community Revitalization Sub-element with modifications noted by Planning Commission and the Sub-element to HCD for certification. Expand Citizen Input via Council Outreach to Neighborhoods |

Coryn Campbell, Neighborhood and Community Services Manager, presented the staff report.Councilmember Howe outlined the purpose for the outreach program and his expectations. He emphasized that the staff's role would facilitate the meetings with the citizens introducing their issues for discussion. The Councilmembers' attendance is strictly voluntary. In response to questions posed by Council, City Attorney Armento responded by giving a brief tutorial on the Brown Act. Mayor Fowler queried if issues that are presented by citizens at informal meetings can be agendized at subsequent meetings of the City Council. City Attorney Armento responded that items could be placed on future agendas. Mayor Fowler opened the Public Hearing at 8:23 p.m. Donna Carrig thanked Councilmember Howe for sponsoring this item. She feels that citizens are more comfortable participating in a less formal arena. Councilmember Valerio queried if a majority of the Councilmembers are allowed to discuss an item that will be on a future City Council agenda. City Attorney Armento responded that this could potentially cause a collective concurrence therefore, Councilmembers should not discuss those items. Tom Mayer expressed his support for informal neighborhood meetings. He also advocated conducting formal City Council meetings out in the neighborhoods. Councilmember Walker inquired if ADA criteria must be met for off-site meetings. The City Attorney opined that any Council-sponsored meeting must meet ADA requirements. Mayor Fowler closed the Public Hearing at 8:56 p.m. Councilmember Howe moved, and Councilmember Walker seconded, approval of staff recommendation to implement the process outlined to increase Councilmember attendance at neighborhood association meetings and other community groups, to include a sunset provision and revisit the item in January 2003. Councilmembers' attendance is to be voluntary, with no formal action to be taken, and staff, at the discretion of the City Manager and City Attorney, is to facilitate the meetings. The motion carried unanimously. |

Appointment to County of Santa Clara Comprehensive Expressway Planning Study Policy Advisory Board |

Jack Witthaus, Transportation and Traffic Manager, presented the staff report. He explained the purpose of the board and their composition. Councilmember Valerio nominated Councilmember Risch to serve as the primary member to the Comprehensive Expressway Planning Study Policy Advisory Board. Councilmember Risch was appointed by unanimous consent of the Council. Councilmember Valerio nominated Councilmember Walker to serve as the alternate member to the Comprehensive Expressway Planning Study Policy Advisory Board. Councilmember Walker was appointed by unanimous consent of the Council. |

Consideration of Establishing Council Sub-Committees |
|
Mayor Fowler explained that the Council Technology Subcommittee and the Council Subcommittee on Moffett Field had achieved their purpose and had not met for quite some time. For those reasons he recommended the Council consider disbanding both subcommittees. Councilmember Vorreiter moved, and Councilmember Walker seconded, not establishing the Council Technology Subcommittee and the Council Subcommittee on Moffett Field for 2002. The motion carried unanimously. |

CITIZENS TO BE HEARD |
Chris Moylan shared a "Notice" that was mailed by AT&T Broadband regarding their policies, complaint procedures and dispute resolution. He questioned whether they are in violation of their Franchise Agreement with the City.
Councilmember Risch asked the City Attorney to review the franchise agreement and write an opinion.
Tom Mayer inquired about the status of the Wildwood Intersection Project.
City Manager LaSala responded that studies have been concluded and the findings will be brought back to Council in the spring.
NON-AGENDA ITEMS & COMMENTS
COUNCIL
Councilmember Vorreiter requested that the subject of participating with the Department of Justice's request to interview named citizens be placed on the next City Council agenda for discussion and formal action and that in the interim actions being taken in this request be suspended. Councilmember Valerio seconded the request and the majority of Council agreed with that request.
Councilmember Valerio requested that the Director of Public Works assess the traffic signalization at the intersections of Hendy and Sunnyvale and Evelyn and Sunnyvale.
He would like an issue added to the Study Issues Workshop in December
to consider planning for the City's Centennial celebration in 10 years.
