MARCH 5, 2002

The City Council of the City of Sunnyvale adjourned from a 5:00 p.m. Joint Study Session with the Parks and Recreation Commission regarding the Review of the Senior Center Project Bids, a 6:00 p.m. Joint Study Session with the Planning Commission regarding the Downtown Urban Design Study, and met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California at 7:30 p.m. with Mayor Fowler presiding.

Mayor Fowler led the salute to the flag.

SPECIAL ORDER OF THE DAY

Science Fair Week

Mayor Fowler presented the proclamation declaring the week of March 10 through March 16, 2002 as Science Fair Week to Susan Lange, representing the Santa Clara Valley Science and Engineering Fair Association.

Arbor Day

Mayor Fowler proclaimed March 7, 2002 as Arbor Day. He presented the proclamation to Ed Apolinar, a member of the Tree Team in the Public Works Department. Mayor Fowler extended an invitation to join the Tree Team at Murphy Park on Thursday, March 7th at 1:00 p.m.

PUBLIC ANNOUNCEMENTS

 

Mayor Fowler reminded the public to go to the polls and vote in the Primary Election today. He noted that the polls are open until 8:00 p.m. and urged anyone who has not voted to go to the polls and vote.

Srikanth Satyanarayana, President of the Sunnyvale Cricket Club, announced that they had won the Division A Championship for two consecutive years. He expressed his appreciation for support from the City in promoting the sport and allowing the use of the Ortega field. As a token of gratitude he presented the Council with their championship trophy for display.

Vice Mayor Miller thanked the members of the Firefighter Ad Hoc Committee, which consisted of Councilmember Howe, Mayor Fowler and Vice Mayor Miller, volunteers and staff for a very successful weekend community event when The City of Sunnyvale hosted a New York City firefighter and his wife for a weekend visit.

Councilmember Vorreiter announced that Sunnyvale has been recognized as the seventh safest city in the United States. She congratulated the Public Safety Department for playing a major role. She also noted the contributions made by the Department of Public Works, Community Development, Parks and Recreation and Libraries. She further congratulated the residents of Sunnyvale for taking pride in their community.

CONSENT CALENDAR

Motion by Vice Mayor Miller, and seconded by Councilmember Howe, for approval of the consent calendar. The motion carried unanimously.

Staff Recommendation: Approve the list of bills.

Award of Contract for Maintenance and Support for the Public Safety Dispatch and Records Management System (F0202-44)

Staff Recommendation: Award a one-year contract in the amount of $64,301 to Tiburon, Inc. of Fremont for software maintenance and support for the Department of Public Safety CAD/RMS system.

Approval of Lease Agreement with NASA for a Portion of the Sunnyvale Golf Course and Budget Modification No.13

Staff Recommendation: Authorize the City Manager to execute the lease with NASA for 35 acres of the Sunnyvale Golf Course for a period of twenty years and approve Budget Modification No. 13.

Neighborhood Preservation Program Update and New Schedule of Fines

 

Christy Gunvalsen, Neighborhood Preservation Manager, presented an in-depth update of the code enforcement program. She introduced the new fee schedule and outlined the broadened scope of authority for enforcement. She explained the program had transitioned from education to enforcement. She responded to questions and concerns posed by Councilmembers. The areas discussed were adequate staffing, penalties for late payment of fines, a progressive citation process where the goal is to bring the property into compliance, and the level of violation based on prior citations.

Vice Mayor Miller applauded the program and noted she is pleased with the results thus far. She suggested continuing with educational outreach efforts, especially relative to leaf blower operations and compliance with the noise ordinance.

Mayor Fowler opened the Public Hearing at 8:36 p.m.

Arthur Schwartz, a member of the public, suggested that leaf blower regulations be advertised in several languages to assist lawn maintenance companies. He suggested alternative methods for reporting sidewalk obstructions.

Jack Robertson, a member of the public, asserted that fixed operational noise complaints have not been adequately addressed.

Mayor Fowler closed the Public Hearing at 8:50 p.m.

Vice Mayor Miller advocated that staff be proactive in reporting suspected code violations.

Councilmember Walker requested a Study Issue for improving methods of reporting potential code violations at the December Study Issues Workshop.

Councilmember Howe moved, and Councilmember Walker seconded, to approve staff recommendation to adopt the resolution establishing a new schedule of fines and amend verbiage on Exhibit "A" to read "within the 36 months of the most recent violation", directed staff to bring a report to council before the next budget cycle, and establish a 10% monthly late fee on the accrued balance of an unpaid fine. Amendment by Miller to Include Council priorities listed on pages 2 and 3 of the RTC and drops the modifier after "Illegal Businesses" which is listed on the priorities. The amendment was acceptable to the maker and second of the motion. The motion carried unanimously.

RESOLUTION NO. 109-02: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE ESTABLISHING AN ADMINISTRATIVE CITATION SCHEDULE OF FINES PURSUANT TO SECTION 1.05.040 OF THE SUNNYVALE MUNICIPAL CODE AND RESCINDING RESOLUTION NO. 179-99.

Status Report On An Ongoing Audit of the Below Market Rate Purchase Program

Annabel Yurutucu, Housing Specialist, presented the staff report.

Councilmember Walker clarified that the application was clear on the intended use of the property.

Councilmember Vorreiter suggested that the investigations be held on a regular basis to assure conformance with program.

No action was required.

CITIZENS TO BE HEARD

 

Jack Robertson invited Councilmembers and staff to the Alviso Post Office to listen for the noise emissions from the WPCP.

NON-AGENDA ITEMS & COMMENTS

COUNCIL

Councilmember Risch queried about the number of apartments transitioning to condominiums. He requested, on behalf of the Friends of Fremont Pool, an annual accounting of the city expenses and revenues for the Fremont Pool.

City Attorney Armento advised that this would best be discussed in conjunction with the issuance of pool provider contracts.

Vice Mayor Miller announced the lawnmower buy back program would offer 160 lawnmowers. The event to take place on May 11th at Home Depot on Kifer Blvd. Motion by Vice Mayor Miller, seconded by Councilmember Walker to reformat the "Directions to Staff" tracking form to move the completed items to the bottom of the list. The motion carried unanimously. She gained a consensus of the Council to add the Superfund for clean up of Moffett Field to appropriation request from Senator Boxer.

Mayor Fowler requested clarification for allocating existing budget for payment of two dinners in conjunction with the NLC Conference. Councilmember Howe offered to absorb the cost for three dinners in his budget. He suggested sharing the cost of a joint dinner with the City of Fremont Council and staff.

Councilmember Valerio noted the passing of Skip (Irma) Ritchie. He acknowledged her many contributions to the community. A memorial service will be held on March 7th at 4:00 p.m. at Saint Martins Church in Sunnyvale.

Mayor Fowler declared the meeting adjourned, in honor of Skip Ritchie, to a Study Session at 9:48 p.m., in the West Conference Room.

ADJOURNMENT

After adjourning the Study Session, regarding the Consent and Agreement for Transfer of Ownership for Town Center Mall from Sunnyvale, LLC, to SVTC, LLC, Mayor Fowler declared the Regular Meeting adjourned at 10:30 p.m.
