Award of Contract for Repairs to the City-owned Downtown Parking Structure (#F0204-60)

REPORT IN BRIEF

Approval is requested for the award of a contract to AWT, Inc., of San Carlos for repairs to the Town Center Mall Parking Structure for the Department of Public Works Project Administration Section.

BACKGROUND

On March 19, 2002, Council approved the Consent and Agreement with American Mall Properties (Sunnyvale, LLC) and Greenwood Partners (SVTC, LLC) to facilitate the sale of the Town Center Mall. In that document, the City agreed to undertake restoration of the parking deck which was partially demolished by American Mall Properties; and American Mall Properties agreed to fully reimburse the City for the restoration cost. Specifically, the Consent and Agreement provides that the City will receive $339,000 from escrow upon closing of the property sale, which is calculated to be 150 percent of the estimated cost for the restoration work. When the work is completed, the City is obligated to return funds not required for the restoration to American Mall Properties.

DISCUSSION

Section 2.09.070(a) of the Sunnyvale Municipal Code states:

"Contracts for public works projects for which the cost to the City in one transaction will exceed fifty thousand dollars shall be let by formal competitive bidding..." [italics supplied]

Because the City will be fully reimbursed for the restoration upon closing of escrow on the property sale, there will be no cost to the City and, therefore, no requirement for competitive bidding of the repairs to the structure.

AWT, Inc., was selected because its principals were part of Schwager Davis, Inc., the firm selected by the construction manager for the mall to do the structural detensioning that accompanied the partial demolition undertaken by American Mall Properties. Because of this experience in the demolition phase of the project, AWT has a good understanding of the existing structural conditions at the parking structure and can effect the fastest and most cost efficient repairs.

Funds are available in Capital Project Account 803100 - Town Center Parking Structure Maintenance. However, cost to the City will be fully reimbursed by American Mall Properties. The contract will not be executed, and the work will not start, until escrow on the sale of the Town Center Mall is closed.

RECOMMENDATION

It is recommended that Council:

1.

Award a contract in the amount of $270,437 to AWT, Inc., of San Carlos for repairs to the Town Center Mall Parking Structure (Base Bid and Additive Alternates); and

2.

Approve a construction contingency in the amount of $27,044.
