Authorization to Purchase Six Police Patrol Sedans Using a State of California Contract (F0204-59)(RTC#02-157) |

|
Approval is requested for the use of a contract initiated by the State of California Department of General Services Procurement Division with Downtown Ford Sales of Sacramento to purchase six police patrol sedans for the Department of Public Works Fleet Maintenance Division. |

BACKGROUND |
|
The requested vehicles are full-size sedans with V8 engines and heavy duty components appropriate for traffic and law enforcement use. Five vehicles will replace existing vehicles that have been driven a minimum of 85,000 miles and are beginning to show signs of mechanical stress with the potential for major component failure. Because of the conditions under which police patrol sedans are driven, vehicular failure of any type would potentially endanger the lives of the officers using the vehicle. One additional vehicle is requested for use with the Bomb Sniffing Dog Project. |

DISCUSSION |
|
Staff has determined that the police patrol sedans available through State of California Contract No. 1-01-23-14-01 meet City specifications. Downtown Ford Sales has agreed to sell six California Highway Patrol-equipped 2002 Ford Crown Victorias to the City under the same price and terms and conditions as the State of California contract.Use of this contract will save the time and expense of soliciting competitive bids; and contract pricing is estimated to be $75.00 per vehicle less than the City could expect to achieve through its own bid solicitation. Section 2.08.220(b) of the Sunnyvale Municipal Code authorizes the procurement of goods through the use of another public agency's contract, provided that the original parties to the contract agree, the contract was awarded within twelve months of the date of authorization, the contract is for identical or nearly identical goods, and the contract resulted from a competitive bid using methods similar to those required for Sunnyvale procurements. In this case, the term of the contract is November 22, 2000, through October 1, 2002, which means that it was awarded more than twelve months ago. Nevertheless, since it is an open contract, it meets the intent of the Municipal Code. All other conditions are met. |

FISCAL IMPACT |
|
Total cost to the City will be $151,787 which includes sales tax, a $500 per vehicle prompt payment discount, delivery to the Corporation Yard, and an extended 75,000 mile/36 month extended warranty with zero deductible. Funds are available in Fleet Equipment Replacement Account No. 020700. |

RECOMMENDATION |
|
It is recommended that Council authorize the use of a contract initiated by the State of California Department of General Services Procurement Division and award a contract in the amount of $151,787 to Downtown Ford Sales for six police patrol sedans. |
