Award of Bid No. F0203-51 for the Construction of the Sunnyvale Skate Park and Budget Modification No. 30 (RTC#02-178)

REPORT IN BRIEF

Approval is requested for the award of a contract to A. J. Vasconi General Engineering of Concord for construction of the Sunnyvale Skate Park and adjoining sidewalk for the Department of Public Works Project Administration Division (Project No. PR-01/05-02).

Approval is also requested for Budget Modification No. 30 for funding in the amount of $ 513,558 for this project.

BACKGROUND

In June 1999, Council concluded a study of teen service expansion options by approving several service level increases for future years. Included was Council's direction to staff to study the feasibility of constructing a skateboard facility in Sunnyvale.

This study, presented to and accepted by Council on August 15, 2000, recommended skate park construction at an estimated cost of $570,092, provided a conceptual design, and identified Fair Oaks Park as the best location. At that time, funds in the amount of $50,000 were budgeted for design of this project. On July 17, 2001, Council awarded a contract to The Beals Group to prepare construction drawings, provide support during the bidding process, and advise and assist staff during skate park construction.

The recommended FY 2001/2002 Budget included an additional $525,000 in Park Dedication Fees to the project for construction, bringing the total appropriation to $575,000.

During the design phase, staff and the consultants recommended that the skate park project be combined with a project for sidewalk construction at Fair Oaks Park that was programmed for a future year. This recommendation was made to avoid numerous disruptions at the park and to achieve cost savings through economies of scale. The Fair Oaks Park sidewalk project was programmed with infrastructure funds, with design scheduled in FY 2006/2007 and construction scheduled for FY 2007/2008.

DISCUSSION

Bid specifications for skate park and sidewalk construction were prepared by Public Works and Purchasing staff with the assistance of The Beals Group. The Notice Inviting Bids was published in The Sun on April 3, 2002; and the bid package was distributed to Bay Area Builders Exchanges, posted on the City's Internet site and broadcast to potential contractors through the DemandStar by Onvia public procurement network. Twelve contractors requested bid packages.

Sealed bids were received and publicly opened on April 24, 2002. Four responsive bids were received.

Staff recommends award of contract to A. J. Vasconi General Engineering, the lowest responsive and responsible bidder.

A determination was made that this project will have no significant effect on the environment in accordance with CEQA guidelines for categorically exempt projects.

FISCAL IMPACT

The bid for this project contains two components: the Skate Park itself and an adjoining sidewalk.

The bid for construction of the Skate Park is $640,000. The total cost for the Skate Park work, including a 15% contingency and consultant costs, is as follows:

To fully fund the project staff is requesting an increase of $279,533 in the Skate Park Project budget. Original budget for this project included $575,000 in Park Dedication Funds. As Council will recall, staff anticipated that bids might come in higher than originally expected due to existing construction markets and specific increases in the cost of concrete. (See attached memo dated December 5, 2001). These additional funds are available from Proposition 12 (The Safe Neighborhood Parks, Clean Water, Clean Air and Coastal Protection Bond Act of 2000) grant monies. Sunnyvale’s grant allocation is $1,595,954, of which $1,168,128 has been appropriated to park projects. This budget modification would appropriate $279,533 from the remaining grant balance of $427,826. Proposition 12 contracts must be executed by June 2003.

In the recommended FY 2000/2001 Budget staff discussed the potential for a shortfall and identified Proposition 12 as a possible source of funding.

The bid for the sidewalk along Wolfe Road at the south entrance to Fair Oaks Park is $203,500. The total cost for the sidewalk work, including a 15% contingency, is $234,025. Infrastructure funds for this work have been set aside in an existing Fair Oaks Park Hardscape Project (822080). Staff is requesting that Council authorize moving $234,025 in future-year funds forward to the current year.

RECOMMENDATION

It is recommended that Council:

1.

Award a contract in the amount of $843,500 to A. J. Vasconi General Engineering;

2.

Approve a construction contingency in the amount of $126,525 (15% of construction costs); and

3.

Approve Budget Modification No. 30 as described in this report.
