2002-0073 - City of Sunnyvale Study Issue:
Work Plan on Privacy Issues Between Residential/Non-residential Developments and Zoning Districts. (Also to City Council on 06/25/02) GCTrudi Ryan, Planning Officer, presented the staff report. She reported that the proposed work plan is the first step of the study issue. She provided a history of the study and reminded the Planning Commission that they met earlier in the year to brainstorm on the work plan. She summarized the work plan.
Comm. Satterlee commented that the work plan is good and recommended that the hours of operation should be included in the issue items related to the privacy impacts to residences. Staff responded that the hours of operations could be included.
Comm. Satterlee commented that commercial vs industrial business should be addressed and would be helpful in the study.
Comm. Moylan asked staff why there is no alternative "not to do" the study? Ms. Ryan responded that the issue was selected and ranked by the Council and that staff is carrying out that direction.
Comm. Babcock commented that the study addresses the various concerns raised by the residents and asked staff whether the residents who would be impacted would have any input. Ms. Ryan responded that there would be meetings for both the residents and the businesses with an opportunity to comment.
Vice Chair Simons asked staff how the landscaping requirement relative to utility easements would be addressed. Ms. Ryan responded that it would be a different study issue. She added that there is also another study pending on in-lieu fees for undergrounding utilities.
Comm. Chu asked if noise regulations and delivery hours could be applied when there is new ownership or tenants. Senior Assistant City Attorney responded that the courts have found that a change of ownership or tenants does not affect legal non-conforming status.

Comm. Satterlee made a motion on Item #2002-0073 to recommend to City Council to approve the work plan with an additional item to consider the hours of operation. Comm. Babcock seconded. |

Ms. Ryan stated that the work plan would be considered by the City Council on June 25, 2002.
