Chief Giusiana,
The County Executive’s Office
informed us recently that the Potential Disparate List was available for 2002
Local Law Enforcement Block Grant (LLEBG) funds.
The
disparate certification portion of the grant cycle will end today, May 16, 2002.
Each State’s Attorney General (SAG), using legislatively mandated
criteria, must certify whether a disparity exists among the jurisdictions
identified by the Bureau of Justice Assistance (BJA).
California’s Attorney General has completed his task and submitted the
list of potentially disparate agencies. The
list of cities in potentially disparate relationships with the county is
included as Attachment 1.
Once the
list is certified the cities must either agree to either share a
percentage of their funding with the county or lose all funding.
Following the posting of the Certified Disparate List, the on-line
application period will open on June 5, 2002 and close on July 17, 2002.

During the
application period, the individual eligible agencies and the county each must
submit their applications and joint spending plans outlining the allocation of
funds.
In
years past, the local law enforcement agencies have agreed to share 22.5% of
their allocation with Santa Clara County. Among
other things, that money was used to support two full-time District Attorney
Investigators assigned to the Sexual Assault Felony Enforcement (SAFE) Task
Force. The LLEBG money has not
covered the whole cost of the two investigators, but the additional cost, as
well as, the 10% matching funds have come from the District Attorney’s budget.
Using the
same formula agreed to in previous years, Attachment 1 shows three columns of
dollar figures: the total LLEBG distribution, the 22.5% city contribution to the
county, and 77.5% the local agency would retain.
If this potential disparate list matches the certified
disparate list then these numbers would be used in preparing the application
and division of funds.
In the past, it has also been agreed that the Chiefs and the Sheriff would be responsible for obtaining local jurisdiction concurrence so the application to BJA can proceed in a timely fashion. Each city executive, or his/her designee, must agree to the allocation and distribution amounts. Can you direct this information to the Chiefs of the cities listed on Attachment 1. It is my hope that this agreement, which worked to everyone’s benefit in the past, can remain in effect this year.
