Rezone Industrial Areas to Residential or Commercial

BACKGROUND (presented by staff)
- This issue has been raised by the City Council due to concerns of residents and businesses regarding the housing shortage.
- This study area was chosen because of its proximity to jobs and it's current mix of land uses.
- It was also chosen because approximately 75 acres of industrial area have already been pre-zoned for residential uses. This zoning district is M-S ITR.
- The M-S ITR Zoning District allows for both industrial and residential uses.
- There is also another study underway that is looking at allowing more industrial square footage north of Highway 237. The additional square footage would increase the number of jobs in the City. Additional housing units would provide housing for the new jobs.
DESCRIPTION OF STUDY AREA (presented by staff)
- The study area is south of Highway 237, North of Highway 101, and west of 237. It includes all industrially-zoned properties.
- The types of businesses range from manufacturing, small office, commercial services and hotels.
- Typical age of structures in this area is 20 to 30 years old.
ALTERNATIVES UNDER CONSIDERATION (presented by staff)
- Rezone certain areas to Medium-Density Residential or Commercial zoning districts. This would make the existing industrial building non-conforming. Non-conforming buildings are not allowed to expand in size.
- Study increased residential densities. This would look at increasing the number of residential units allowed in the ITR area. This could increase the value of the land as a residential property.
- Make no change. No additional regulations or measures would be taken to encourage residential construction in this area.
- Other. Other alternatives may be introduced by the City Council.
COMMENT (from participants)
- Consider a phasing program to rezone small areas to residential.
- High density uses near the freeway are more valuable.
- Developing a City park in that area first might encourage properties to develop with residential.
- A commercial center is necessary for viable residential in that area.

- Look at vacant buildings in the Moffett Park area for rezoning to residential.
- Area there adequate schools and parks in that area for residents?
- Industrial chemicals may make some sites inappropriate for residential development.
- Conflicting uses long the freeway are already pre-determined.
- Our residential needs may not be the same as they are 10 years ago. They may be different in 10 years.
- It's important to preserve space for small businesses.
- The economy and dot-com businesses has pushed out small service businesses.
- Rezoning the area may force out other uses (such as an upholstery business).
- Some businesses are very important to their customers; customers travel from far away to buy their services and products.
- Anything that conflicts with property owner's quiet enjoyment of the property is a "down-zoning."
- What happens in Moffett Park will affect the ITR area.
- Affordability
- There should be no change made to the area.
