AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE FIXING AND LEVYING AD VALOREM ASSESSMENTS FOR FISCAL YEAR 2002-2003 ON ALL LAND AND IMPROVEMENTS WITHIN THE DOWNTOWN PARKING MAINTENANCE DISTRICT
THE CITY COUNCIL OF THE CITY OF SUNNYVALE DOES ORDAIN AS FOLLOWS:
SECTION 1. ASSESSMENT FOR BOND REPAYMENT. An ad valorem assessment is hereby fixed and levied in the amount of $.05216 on each $100.00 of full cash value upon all land and improvements within the Downtown Parking Maintenance District of the City of Sunnyvale as shown on the assessment roll for the payment of principal and interest on all bonds issued heretofore for improvements within the District.
SECTION 2. CEQA EXEMPTION. The City Council finds, pursuant to Title 14 of the California Code of Regulations, Sections 15061(b) (3) and 15378(a), that this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect on the environment. This action is further exempt under the definition of Project in Section 15378(b)(3) in that it concerns general policy and procedure making. The Council therefore directs the City Clerk to file a Notice of Exemption with the Santa Clara County Clerk in accordance with Section 14 of the Sunnyvale Guidelines for the implementation of CEQA adopted by Resolution No. 193-86.
SECTION 3. EFFECTIVE DATE. In accordance with Section 705 of the City Charter, this ordinance shall take effect upon adoption.
SECTION 4. SEVERABILITY. If any provision of this ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional or invalid, such decision shall not affect the validity of the remaining provisions of this ordinance.
SECTION 5. TRANSMITTAL. The Director of Finance shall cause a certified copy of this ordinance to be delivered to the Auditor of the County of Santa Clara for entry in the assessment book of the respective sums, in dollars and cents, to be paid as the ad valorem assessments fixed and levied in this ordinance on the property enumerated and assessed as being in the Downtown Parking Maintenance District of the City of Sunnyvale.
SECTION 6. PUBLICATION. The City Clerk is directed to cause this ordinance to be published at least once within fifteen (15) days after its adoption in The Sun, the official newspaper of the City of Sunnyvale.
