SUBJECT: Appeal of the Planning Commission Agenda of September 23, 2002 and the Administrative Hearing Agenda of September 25, 2002

REPORT IN BRIEF

This report represents the Planning Commission Agenda and Administrative Hearing Agenda items that may be appealed by any member of the Council. Council should specify the reason for an appeal and indicate any appealed items on which it wishes to have expanded notification.

  1. Appeal of the Planning Commission Agenda of September 23, 2002

  1. 2002-0593 - AT&T Wireless [Applicant] Michael Loskutoff [Owner]: Application for a Use Permit to allow the co-location of six wireless panel antennas on an existing monopole with associated ground equipment. The property is located at 1391 Geneva Drive in an M-3 (General Industrial) Zoning District. (APN: 110-33-019) (Negative Declaration) RK (APPROVED WITH MODIFICATIONS)

  B.  Appeal of the Administrative Hearing Agenda of September 25, 2002

  1. 2002-0636 - Alex Birman [Applicant] Yamaoka Associates [Owner] - Application for a Special Development Permit to allow a 1,100 square foot restaurant with live entertainment in an existing 24,853 square foot shopping center (Marketplace Center). The property is located at 833 West El Camino Real in a C-2/PD (Highway Business/Planned Development) Zoning District. (APN: 165-01-042) DO (APPROVED ON SEPTEMBER 27, 2002 WITH MODIFICATIONS)
  2. 2002-0640 - Beverly Chipman [Applicant] Enterprise Rent A Car [Owner] - Application for a Special Development Permit to allow a 2,304 square foot modular office building for car rentals and sales. The property is located at 923 West El Camino Real in a C-2/PD (Highway Business/Planned Development) Zoning District (APN: 165-01-035) EW (APPROVED WITH MODIFICATIONS)
  3. 2002-0641 - Plamar USA [Applicant] Consolidated Freightways Corporation of Delaware [Owner] - Application for a Use permit to allow exterior storage in excess of 5% of the lot area. The property is located at 1319 Moffett Park Drive in an M-3 (General Industrial) Zoning District (APN: 110-37-006) (GC) (APPROVED WITH MODIFICATIONS)
  4. 2002-0655 - Tailiang Li [Applicant] Dubrovnik Associates [Owners] - Application for a Special Development Permit to allow a personal service use for foot soaking. The property is located at 610 Town and Country Lane in a DSP1 (Downtown Specific Plan/Block 1) Zoning District (APN: 209-07-009) (EW) (APPROVED)

RECOMMENDATION

The Council should review the agenda and appeal an application where appropriate, specifying the reason for the appeal.
