AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING SECTION 19.46.060 OF THE SUNNYVALE MUNICIPAL CODE RELATED TO OFF-STREET PARKING REQUIREMENTS FOR RESIDENTIAL USES
THE CITY COUNCIL OF THE CITY OF SUNNYVALE DOES ORDAIN AS FOLLOWS:
SECTION 1. SECTION 19.46.060 AMENDED. Section 19.46.060 of the Sunnyvale Municipal Code is hereby amended by modifying subsection a(2), a(3), inserting a new subsection a(4) and renumbering existing subsection a(4), as follows:
19.46.060 Parking Areas – Consolidation or conversion
(a) Residential Uses

(2) Any modifications to existing residential buildings which trigger that result in increased parking requirements pursuant to Table 19.46.050 shall be permitted only if the increased requirements can must be met.
(3) Any conversion of parking spaces to non-parking uses for which a building permit was obtained that does not comply with current parking standards is deemed considered a legal nonconforming building.
(4) Effective March 1, 2003, any application for modification or addition to a single family home which would increase the total square footage of the home (including square footage of covered parking spaces, i.e., garages and carports) to 1800 or more square feet, or which would add more square footage to an already existing 1800 or greater square foot home, or which would result in four or more bedrooms, shall not be granted unless the site provides the two covered parking spaces required by Table 19.46.050. For purposes of this subdivision, the term bedroom shall be liberally defined, and shall include any room intended for or capable of being used for sleeping purposes. For example, a room designated as a "den," "study," "loft," "library," or other extra room that is not a kitchen, living room, dininig room or bathroom shall be considered a bedroom.

SECTION 2. Negative Declaration CEQA. The City Council hereby determines that the Negative Declaration prepared for this ordinance has been completed in compliance with the requirements of the California Environmental Quality Act (CEQA) and reflects the independent judgment of the City, and finds that adoption of the ordinance will have no significant negative impact on the area's resources, cumulative or otherwise. The Director of Community Development shall file a Notice of Determination with the County Clerk pursuant to CEQA guidelines.
SECTION 3 . EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days from and after the date of its adoption.
SECTION 4. POSTING AND PUBLICATION. The City Clerk is directed to cause copies of this ordinance to be posted in three (3) prominent places in the City of Sunnyvale and to cause publication once in The Sun, the official newspaper of the City of Sunnyvale, of a notice setting forth the date of adoption, the title of this ordinance, and a list of places where copies of this ordinance are posted, within fifteen (15) days after adoption of this ordinance.
