Appropriation of Measure B Pavement Management Program funds and Award of Contract for Design and Construction Support Services for Measure B Street Pavement Maintenance (#F0201-62) and Budget Modification No. 33 |

REPORT IN BRIEF |
|
This report recommends City Council appropriate Measure B Pavement Management Program (PMP) funds to eight new capital projects, and amend the budget for three existing Measure B PMP projects. These projects require expedited administration in order to meet the Measure B PMP completion deadline of July 31, 2004. Approval is also requested for the award of a contract to Nichols Consulting Engineers, CHTD, of Santa Cruz, to provide the design and construction support services for the Measure B projects managed by the Public Works Project Administration Division (Project No. ST-02/04-03). |

BACKGROUND |
|
Under the terms of the Measure B PMP, the City is required to expend all Measure B funds allocated for street maintenance and complete the projects by July 31, 2004. Funds not expended by the deadline date will be rescinded by VTA. The design phase of street improvement projects takes a considerable length of time to finish due to the pavement deflection tests that must be performed on each street. In addition, staff must work with a narrow construction timeframe due to weather restrictions that exclude late fall and winter. Due to these factors, it is imperative that these capital projects be expedited in FY 2002/2003 to enable the design phase to begin as early as possible and ensure construction can be completed before July 31, 2004. |

DISCUSSION |
|
Staff recommends the following new street improvement projects be created in FY 2002/2003, funded by Measure B PMP monies:
In addition, based on the most current engineering estimates, staff recommends budget amendments for the following three existing projects: Staff recommends retaining the services of Nichols Consulting Engineers to complete the design for projects one through nine listed above. Contracting with Nichols will save time by leveraging their experience gained from the design of the most recent Measure B street projects. Nichols also has the flexibility to start the design for these projects immediately. Section 2.08.070(b) of the Sunnyvale Municipal Code exempts from competitive bidding contracts for professional services. Upon completion of design, it is anticipated that pavement maintenance will be performed this summer on half of the streets listed; and the remainder will be completed before the deadline of July 31, 2004. |

FISCAL IMPACT |
|
Staff recommends City Council appropriate Measure B Pavement Management Program funds to the street maintenance projects outlined below and amend the budget for three existing Measure B PMP street projects. Staff also recommends the allocation of $386,577 in Measure B funds to support the Lawrence/Elko Traffic Signal project, which was originally budgeted in FY 2002/2003 with AB 2928 Traffic Congestion Relief Funds. However, due to the State of California budget shortfall, there are insufficient AB 2928 funds to support this project. The design and warrant study for the Lawrence/Elko Traffic Signal project is completed and the project is ready for the construction phase. Award of contract to Nichols Consulting Engineers, CHTD, for the design and construction support services of projects one through nine is also recommended. The cost of the contract will be funded by the Measure B funds appropriated by this Budget Modification. |
