SUNNYVALE CITY COUNCIL
APRIL 29, 2003

The City Council of the City of Sunnyvale met in regular session in the City Council Chambers, 456 West Olive Avenue, Sunnyvale, California at 7:30 p.m., with Mayor Miller presiding.

SPECIAL ORDER OF THE DAY

Mayor Miller announced that she and City Manager Robert LaSala attended the California Council of Excellence Ceremony in San Diego and accepted the California Award for Performance Excellence (CAPE). Mayor Miller presented the award to City Manager LaSala and stated that Sunnyvale is the first city in California to receive this award.

Mayor Miller and Ernie Bakin, Director of Public Safety, presented a Certificate of Appreciation to Dan Henderson for his courageous actions in rescuing an infant from a car accident.

Mayor Miller declared the week of April 27th, 2003 as National Volunteer Week. She was joined by Romie Georgia, Volunteer Services Manager, and volunteers Lisa Johnson and Priya Subramanian. Mayor Miller announced that Sunnyvale will honor its volunteers at a special reception in the lobby of City Hall on May 6th at 5:30 p.m.

PUBLIC ANNOUNCEMENTS

Dave Simons, Chair of the Planning Commission, announced the Bianchi Barn dedication barbecue and barn dance on Saturday, May 17th, starting at 5:30 p.m. at the Community Center, 550 East Remington Drive.

Mayor Miller announced three new additions to the Sunnyvale Wall of Honor. They are:

Specialist Montana McKinsey, U.S. Army, Ensign Kresten M. Jensen, U.S. Navy, and Sergeant Jeffrey R. Strong, U.S. Army.

Sunnyvale residents are invited to send photographs of their immediate family members serving on active duty. Photos may be dropped off at City Hall marked "Wall of Honor" or may be emailed to: honor@ci.sunnyvale.ca.us. Each photo should have the military member’s complete name, rank, and branch of service. Vice Mayor Risch made the following announcements on behalf of the Council:

The Downtown Stakeholders Advisory Committee will meet to review the public input received on the Downtown Design Plan, consider the results of the Environmental Impact Report, and determine whether the Committee wishes to revise or supplement its recommendation to the City Council. This meeting will be held on Thursday, May 1st, at the Neighborhood Room in the Sunnyvale Community Center on Remington Drive (from 5:00 p.m. to 7:00 p.m.). The City of Sunnyvale is currently recruiting for members on the following Boards and Commissions:

Eligible candidates must be a Sunnyvale resident and a registered voter. An information meeting will be held on May 1st, at 6:00 p.m. in the Sunnyvale City Hall West Conference Room. The Sunnyvale Public Library will be the site of a program called "What Freedom Means to You" on Thursday, May 1st, from 7:00 - 9:00 p.m. This is the first in a series of programs, "Conversations on Freedom," to be presented in area libraries. This program is hosted by The Silicon Valley Library System, Markkula Center for Applied Ethics, San Jose Mercury News, American Leadership Forum, and Community Foundation Silicon Valley. It will be a moderated conversation among members of the public. Facilitators include, Sheriff Laurie Smith, Omar Ahmad, Thanh Nguyen, and Judge Jeremy Fogel. The City of Sunnyvale has been granted a Class 7 community rating by the Federal Emergency Management Agency (FEMA) effective May 1st, 2003. This new rating will enable Sunnyvale citizens and businesses to obtain a 15% discount on their flood insurance premiums. The City’s participation in the CRS Program is expected to save property owners approximately $75,000 per year in premium reductions. The National Flood Insurance Program (NFIP) provides federally backed flood insurance that encourages communities to enact and enforce floodplain regulations. Sunnyvale has been a member of the NFIP since it’s inception. An Information-Only RTC is on tonight's agenda and a copy can be obtained from the City Clerk’s office or the Sunnyvale web site at www.ci.sunnyvale.ca.us.

The City of Sunnyvale will host the Grand Opening of the Sunnyvale Skatepark on Saturday, May 3rd, at Fair Oaks Park. The celebration will begin with a ribbon cutting ceremony from 11:00 a.m. to 11:30 a.m., and continue until 5:00 p.m. with public skating, pro-skating demonstrations, and food. The "Phatty Patty" music festival will begin at 11:30 a.m., and will feature various live bands, teen resource booths, and other recreational activities – all free to the public. Hands on the Arts, a special annual children’s event sponsored by the City of Sunnyvale, will be held on Saturday, May 17th, from 11:00 a.m. to 4:00 p.m. at the Sunnyvale Community. Please donate your old ties for this year’s event by dropping them off at the Library, Senior Center, Community Center, Recycle Center, One-Stop Permit Counter, or Annex Bill Payment Center, by Friday, May 16th. Mayor Miller announced the City of Sunnyvale, in cooperation with the Bay Area Air Quality Management District, conducted a Lawn Mower Buy-back Event at the Sunnyvale Home Depot on Saturday, April 26th, to promote making the "clean air choice". A total of 108 gas-powered mowers were recycled, and 107 new electric mowers were purchased. This year, all sixty Sunnyvale residents interested in the program exchanged their gas mowers for the discounted electric mower. Extensive publicity by the City and the BAAQMD attracted 32 residents of other cities who were also able to turn in gas mowers and take advantage of the rebate. In addition, approximately 15 individuals, who were turned away from the previous, oversubscribed countywide event, were served.

BOARD AND COMMISSION ANNOUNCEMENTS

Kevin Gregory, Chair of the Bicycle and Pedestrian Advisory Committee (BPAC), reported that May is known as "California Bike Commute Month", with the main event being Bike to Work Day on May 15th. He stated the BPAC will host three energizer stations for bicyclists at the Caltrain station, the intersection of Mary and Maude Avenues, and at Wolfe Road and El Camino. Bike to Work Day will also host a short noontime ride that will begin and end at Yahoo. Mr. Gregory summarized the Committee’s efforts over the past year and expressed support for preserving the funding for critical bike-related projects.

Staff Recommendation: Award a two-year contract, in an amount not to exceed $337,632, to Andrade Trucking, Inc., for aggregate, crushed granite and sand on an "as needed" basis, and authorize the Purchasing Officer to issue a Blanket Purchase Order to that effect.

Consideration of Heritage Resource Designation of a Property Located at 550 E. Remington Avenue in a P-F (Public Facility) Zoning District (APN: 211-24-021)

Gerri Caruso, Principal Planner, presented the staff report. She stated in November 2002, the City Council entered into an agreement with the Sunnyvale Historical Society and Museum Association for handling the relocation of the Bianchi Barn. In order to reconstruct the barn in a more accurate manner, the Building Official applied the California Historic Building Code. She stated that prior to final occupancy, an official historic designation is required to satisfy the requirements of the Historic Building Code.

Mayor Miller opened the Public Hearing at 8:03 p.m.

Laura Babcock, representing the Sunnyvale Historical Society, expressed support for the Bianchi Barn project and historic designation.

Mayor Miller closed the Public Hearing at 8:05 p.m.

Councilmember Howe moved, and Councilmember Vorreiter seconded, to adopt a Heritage Resource designation for the Bianchi Barn. The motion carried unanimously.

Funding Request for Construction at Moulton Plaza, 1601 Tenaka Place by Mid-Peninsula Housing Coalition and Budget Modification No. 40

Annabel Yurutucu, Housing Officer, presented the staff report. She reported that the Mid-Peninsula Housing Coalition (MPHC) has requested $992,000 of Sunnyvale Housing Funds for construction of an additional 66 units of new affordable rental housing, and $400,00 of Community Development Block Grant (CDBG) for exterior rehabilitation of 1601 Tenaka Place. Ms. Yurutucu stated funding for this project is currently available in the CDBG Housing Rehabilitation activity, and Housing Mitigation Reserves in the Housing Fund.

Mayor Miller opened the Public Hearing at 8:09 p.m.

IrisAnn Nelson, Chair of the Housing and Human Services Commission, reported the Commission unanimously supports this project.

David Schnur, Mid-Peninsula Housing Coalition, expressed support for the project.

Robert Paternoster, Director of Community Development, stated the project saved 220 affordable housing units that would have been lost, and built 66 new affordable housing units. This meets two objectives of the Community Development strategy.

Mayor Miller closed the Public Hearing at 8:15 p.m.

Councilmember Vorreiter moved, and Vice Mayor Risch seconded, to approve Budget Modification No. 40 for $992,000, a loan from the Housing Sub fund for new construction of 66 rental units, and approve a loan of $40,000 of CDBG funds for the exterior rehabilitation of 112 rental units. The motion carried unanimously.

Recommendations for Funding Community Event Grant Applications

John Pilger, Communications Officer, assisted by Adam Levermore-Rich, Deputy Communications Officer, presented the staff report. He reviewed the history of funding for Community Event Grant Applications stating Council approved an annual budget of $25,000 for community event grant support. Mr. Pilger reviewed the grant funding eligibility requirements and evaluation criteria. He stated staff recommends funding $330.00 to the Lakewood Village Neighborhood Association Holiday Parade, $19,250.00 to the Sunnyvale Downtown Association Summer Series Music and Market, and $2,000.00 to the Sunnyvale Downtown Association Holiday Tree Lighting.

Vice Mayor Risch inquired why athletic competitions were excluded. Mr. Pilger responded the sporting events that were submitted did not meet the criteria of celebration of community.

Vice Mayor Risch inquired if the evaluation criteria was published to the submitters. Mr. Pilger responded it was part of the application package.

Mayor Miller inquired why the Little League did not meet the application criteria, noting they were only .5 below the criteria. Mr. Pilger responded they did not meet the criteria of attracting a broad enough group.

Amy Chan, Assistant City Manager, clarified the Committee followed the original intent of Council for funding and criteria.

Mayor Miller opened the Public Hearing at 8:28.p.m.

Joe Antuzzi, of the Sunnyvale Downtown Association, expressed appreciation for considering funding for the Downtown events.

Mayor Miller closed the Public Hearing at 8:29 p.m.

Councilmember Walker moved, and Councilmember Vorreiter seconded, to approve staff’s recommended grant funding without adjustments based on in-kind services. The motion carried unanimously.

CITIZENS TO BE HEARD

Eric Boucher’, representing the Courtyard Condominium Complex, reported that Caltrain had erected a large structure at the rear of their complex without any notification to the residents. He displayed a photograph of the structure.

Councilmember Valerio informed Mr. Boucher’ that Caltrain has scheduled a meeting with the residents for May 5th and apologized on behalf of Caltrain. He will take the residents’ concerns to the Caltrain Board Meeting on May 1st.

Councilmember Vorreiter inquired if Sunnyvale had been noticed by Caltrain about this project. City Manager LaSala will follow up with Caltrain, and staff will notify Mr. Boucher’ of their findings.
