SUBJECT:

Appointment of City of Sunnyvale Representative to Bay Area Water Supply and Conservation Agency (BAWSCA).

REPORT IN BRIEF

Pursuant to AB 2058, the San Mateo Board of Supervisors has declared that the Bay Area Water Supply and Conservation Agency (BAWSCA) has been formed. At this time it is appropriate for Sunnyvale to appoint its representative to the Board of Directors of BAWSCA. The first meeting of BAWSCA is expected to be in June 2003, in coordination with the second meeting of the Regional Financing Authority (RFA). It is anticipated that BAWSCA and the RFA can most easily coordinate functions and meetings if agencies appoint the same person as the representative to both organizations. Sunnyvale appointed Vice Mayor Tim Risch to the RFA. It is recommended that Vice Mayor Risch also be appointed to BAWSCA.

BACKGROUND

Assembly Bill 2058 (Papan), the Bay Area Water Supply and Conservation Agency Act, outlined the steps for the creation of BAWSCA. Sunnyvale supported the adoption of that legislation. The Council discussed the creation of BAWSCA at the March 18 meeting, and took public testimony supporting creation of, and participation in, BAWSCA. As required in the legislation, Sunnyvale submitted the record of the March 18 Council action to participate in the creation of BAWSCA to the San Mateo County Board of Supervisors. The Board of Supervisors has received the record of all of the agencies taking that action, and has declared the formation of BAWSCA. It is now appropriate for Council to appoint a representative that will hold the title of Director on the Board of Directors of BAWSCA.

At Council’s February 11, 2003 meeting, Vice Mayor Risch was appointed to the Board of Directors of the San Francisco Bay Area Regional Water System Financing Authority (RFA). At that time it was discussed that the person appointed to the RFA should also be appointed to BAWSCA. Council considered that as a factor in selecting Vice Mayor Risch for the RFA.

EXISTING POLICY

LAP 3.1 (3) Support and participate in the creation of the Bay Area Water Supply and Conservation Agency (BAWSCA), as provided in AB 2058, intended to:
a) plan for and acquire supplemental water supplies;
b) encourage water conservation and use of recycled water on a regional basis
c) assist in the financing of essential public works in a coordinated and cost-effective manner.

DISCUSSION

All 26 of the suburban wholesale customers of the San Francisco Water Department that were empowered by AB 2058 (Papan) to create the Bay Area Water Supply and Conservation Agency (BAWSCA) have completed their process. Pursuant to AB 2058, the San Mateo Board of Supervisors has declared that BAWSCA has been formed. At this time, it is appropriate for Sunnyvale to appoint its representative to the Board of Directors of BAWSCA. The first meeting of BAWSCA is expected to be in June 2003, in coordination with the second meeting of the Regional Financing Authority (RFA). It is anticipated that BAWSCA and the RFA can most easily coordinate functions and meetings if agencies appoint the same person as the representative to both organizations. Sunnyvale appointed Vice Mayor Tim Risch to the RFA.

At the first meeting of the RFA, on April 3, 2003, there was discussion concerning the determination of which directors shall initially serve for 2 years, and which shall serve for 4 years. It was decided that this would be determined at the next meeting of the RFA, in conjunction with, and simultaneously to BAWSCA. The intent is to provide for the greatest efficiency possible between the RFA and BAWSCA, and further promote the appointment of the same person from each agency to serve on both boards. This is expected to take place in June 2003, when the RFA holds its second meeting, and the first meeting will be scheduled for BAWSCA.

Consistent with these actions, it is the recommendation of this report that Vice Mayor Risch also be appointed to BAWSCA.

Public contact was made through posting of the Council agenda on the City's official notice bulletin board, posting of the agenda and report on the City's web page, and the availability of the report in the Library and the City Clerk's Office.

ALTERNATIVES

Council has already elected to form BAWSCA. Therefore, the selection of a Director is required. The alternatives would be around who to chose as Director.

  1. Select Vice Mayor Risch as Sunnyvale’s Director to BAWSCA.
  2. Select someone else as Sunnyvale’s Director to BAWSCA.

RECOMMENDATION

Staff recommends Alternative 1.
