SUBJECT: Appeal of the Planning Commission Agenda of April 28, 2003 and the Administrative Hearing Agenda of April 30, 2003

REPORT IN BRIEF

This report represents the Planning Commission Agenda and Administrative Hearing Agenda items that may be appealed by any member of the Council. Council should specify the reason for an appeal and indicate any appealed items on which it wishes to have expanded notification.

  1. Appeal of the Planning Commission Agenda of April 28, 2003

  1. 2003-0143 - Application for a Design Review to allow a first and second story addition to an existing two-story house for a total of 3,258 square feet resulting in a 53% FAR (Floor Area Ratio) where 45% is allowed without a Planning Commission review. The property is located at 874 Maranta Avenue in an R-0 (Low-Density Residential) Zoning District. (APN: 198-31-020) SL (Approved with Modification)

  1. Appeal of the Administrative Hearing Agenda of April 30, 2003
  1. 2003-0220 - Tim Bevins [Applicant] George Yamaoka [Owner] - Application for a Special Development Permit for a social club within an existing building. The property is located at 1155 Reed Avenue in an M-S/R-3/ITR/PD (Industrial & Service/Medium-Density Residential/Industrial to Residential/Planned Development) Zoning District. (APN: 213-01-033) KD (Approved on May 2, 2003 with Modifications. Appeal Period ends Monday, May 19, 2003)
  2. 2003-0214 - Application for a Special Development Permit to allow an existing shed to encroach into a required side yard and the required rear yard. The property is located at 389 Carroll Street in a DSP/8b (Downtown Specific Plan/Sub-district 8b) Zoning District. (APN: 209-25-021) CC (Approved with Modifications)
  3. 2003-0228 - Application for a Variance from SMC (Sunnyvale Municipal Code) section 19.34.060 to allow a single story addition to encroach into a required 40-ft. corner vision triangle at the intersection of Alberta and Norland Avenues. The property is located at 1549 Norland Drive in an R-2 (Low-Medium Density Residential) Zoning District. (APN: 323-28-068) DO (Denied)
  4. 2003-0229 - Josline Ferguson [Applicant] Nick Gera [Owner] - Application for a Special Development Permit to allow the sale of beer & wine and live entertainment in an existing restaurant. The property is located at 404 Town & Country in a DSP-1 (Downtown Specific Plan/Sub-district 1) Zoning District. (APN: 209-07-014) RK (Approved)
  5. 2003-0188 - BKF Engineers [Applicant] California Water Services Company [Owner] - Application for a Tentative Map to subdivide one 1.432 acre parcel into two parcels of .261 acres and 1.171 acres. The property is located on the southwest corner of Crescent Avenue and Picasso Drive in an R-2/PD Zoning District. (APN: 211-37-021) CC (Approved with Modifications on May 7, 2003. Appeal Period ends Thursday, May 22, 2003)

RECOMMENDATION

The Council should review the agenda and appeal an application where appropriate, specifying the reason for the appeal.
