Award of Contract for Technical Support and Software Licenses for Network Database Users (F0205-96)(RTC#03-180) |

REPORT IN BRIEF |

|
Approval is requested for the award of a one-year contract to the Oracle Corporation of Rocklin for network database user software licenses and technical support for the Information Technology Department. |

BACKGROUND |
|
|
The City's Integrated Financial System software runs on an Oracle database. The City has licensed 100 concurrent users and Oracle "Premium Support" technical/software support for this application. The fees for calendar year 2003-2004 will exceed $50,000, requiring Council approval. |

DISCUSSION |
|
|
Section 2.08.070(b) of the Sunnyvale Municipal Code exempts from competitive bidding those situations where the City's requirements can be met solely by a single patented article or process. In this case, the Oracle database software is proprietary to Oracle; and user licenses and ongoing software maintenance and support is available only from Oracle. |

FISCAL IMPACT |
|
|
Total cost to the City for a one-year licensing/support agreement will be $52,618 (tax included). Funds are available in Information Technology Account #766090 - Maintain Vendor Contracts for Applications Software. |

RECOMMENDATION |
|
|
It is recommended that Council award a one-year contract in the amount of $52,618 to the Oracle Corporation of Rocklin for network user software licensing and technical support and authorize the Purchasing Officer to issue a Purchase Order to that effect. |
