SUBJECT: RATIFICATION OF MAYOR MILLER’S APPOINTMENT TO THE LEAGUE OF CALIFORNIA CITIES ETHICS EDUCATION TASKFORCE

REPORT IN BRIEF

Traditionally, in January of each year the City Council fills a number of positions for intergovernmental (IGR) assignments. Periodically during the year Councilmembers receive additional appointments. After the March 18, 2003, Report to Council on IGR assignments, Mayor Julia Miller was appointed by the League of California Cities (LCC) to their Ethics Education Taskforce. Because this intergovernmental appointment was made by an outside agency, Council must ratify it. Attachment A is an updated list of the IGR assignments, which includes Mayor Miller’s new appointment, and expiration of term.

BACKGROUND

The City Council annually appoints members to a variety of intergovernmental agencies in order to represent the City's interests and to influence policies and regulations of other agencies. There are some intergovernmental agencies on which Councilmembers serve, but are appointed by other agencies (i.e., League of California Cities policy committees and National League of Cities policy and steering committees, City Selection Committee appointments, etc.). The Council ratifies these appointments. In addition, the Mayor or her designee has a seat on the Santa Clara County Cities Selection Committee and the Military Affairs Council.

EXISTING POLICY

GOAL 7.3C: PARTICIPATE IN INTERGOVERNMENTAL ACTIVITIES, INCLUDING NATIONAL, STATE AND REGIONAL GROUPS, IN ORDER TO REPRESENT THE CITY'S INTEREST, INFLUENCE POLICY AND REGULATIONS, AND ENHANCE AWARENESS.

DISCUSSION

Since Council's approval of the IGR Assignments in March, the League's approval of California Cities (LCC) appointed Mayor Miller to their newly created Ethics Education Task Force. By City policy Council is required to review and ratify all appointments that are made by outside agencies. In reviewing the new appointments, Council should consider the City's overall intergovernmental priorities and the particular interests and backgrounds of individual Councilmembers. Council ratifies appointments by other agencies only when first made if they have set terms, but annually if they do not have set terms.

The League of California Cities (LCC) is the statewide organization representing the interests of city governments before the State legislature. The Peninsula Division is a division of the organization that represents all the Cities extending from San Jose to San Francisco located on the San Francisco Bay Peninsula. LCC provides a number of conferences, training services and publications such as: weekly Legislative Bulletins, League Newsletters, Western City Magazine, Employee Relations information and training. The LCC President created the Ethic Education Task Force this year and appointed both elected and non-elected official members. The overall scope of the group is currently being defined. However, currently the task force is responsible for reviewing and participating in the LCC ethics training and other activities.

FISCAL IMPACT

There is no fiscal impact to this report.

Public contact was made through posting of the Council agenda on the City's official notice bulletin board, posting of the agenda and report on the City's web page, publication of the Council agenda in the San Jose Mercury News, and the availability of the report in the Library and the City Clerk's Office.

Alternatives

  1. Council ratify Mayor Julia Miller's appointment to the LCC Ethic Education Task Force.
  2. Council doesn’t ratify the appointment.
  3. Take no action at this time.

RECOMMENDATION

Staff recommends alternative 1.
