What are the key elements of the issue? What precipitated it?

Assembly Bill 1866 was recently adopted by the State amending certain sections of the Government Code relating to housing. The bill requires that, effective July 1, 2003, any application received for a second unit "shall be considered ministerially without discretionary review or hearing". SMC 19.18 currently requires a use permit for detached accessory units (second units). Development standards for second units are allowed such as limits to size, architectural compatibility with the main structure and so forth. Implementation of the bill will also require amendment to SMC 19.68 "Mobile and Accessory Living Units".

Policy D1.b Continue the Accessory Living Unit Ordinance, required by State Law, as a means to increase the supply of affordable units.
