A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE PROVIDING FOR THE COLLECTION OF SEWER SERVICE CHARGES ON PROPERTY OUTSIDE THE CITY FOR FISCAL YEAR 2003/2004

WHEREAS, the City of Sunnyvale elects, pursuant to Section 5473 of the Health and Safety Code and Section 12.16.020 of the Sunnyvale Municipal Code to have the sewer service charges for premises outside the City limits for fiscal year 2003/2004 collected on the tax roll of the County of Santa Clara, State of California, in the manner provided pursuant to Sections 5473 through 5473.11 of the Health and Safety Code; and

WHEREAS, the City Council finds that the City Manager has caused a report to be prepared and filed with the Office of the City Clerk, on May 27, 2003, pursuant to Section 5473 of the Health and Safety Code; and

WHEREAS, on Tuesday, June 17, 2003, at 7:30 p.m., in the Council Chambers, 456 West Olive Avenue, Sunnyvale, California, a public hearing was held on the report;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNYVALE THAT:

  1. Sewer service charges for property located outside the City limits shall be at the same rates as for property located within the City limits.

2. If the sewer service charges are unpaid and become delinquent on the dates specified in Sections 2617 and 2718 of the Revenue and Taxation Code, or as amended, the following delinquency penalties shall attach to them:
  1. A basic delinquency penalty of ten percent (10%); and

(b) An additional delinquency penalty of one-half of one percent (.5%) per month.

All such delinquency penalties shall be collected at the same time and in the same manner and by the same person as are delinquency penalties on general taxes for the City of Sunnyvale.

3. The City Council finds, pursuant to Title 14 of the California Code of Regulations, Section 15061(b)(3) and 15378(a), that this resolution is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect on the environment. This action is further exempt under the definition of Project in Section 15378(b)(3) in that it concerns general policy and procedure making.
