ORDINANCE NO. 2731-03
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUNNYVALE AMENDING SECTIONS 19.26.200, 19.32.020, 19.40.030 AND 19.40.040 OF THE SUNNYVALE MUNICIPAL CODE RELATING TO LOT COVERAGES
THE CITY COUNCIL OF THE CITY OF SUNNYVALE DOES ORDAIN AS FOLLOWS:
SECTION 1. SECTION 19.26.200 AMENDED. Section 19.26.200 of the Sunnyvale Municipal Code is hereby amended by amending Subsection 19.26.200(f)(3) to read:
19.26.200. Residential single-story combining district (S).

(f) For sites within the single-story combining district, the following development regulations shall apply in lieu of the otherwise applicable site development regulations:

(3) The maximum floor area ratio shall be forty-five percent.
SECTION 2. SECTION 19.32.020 AMENDED. Section 19.32.020 of the Sunnyvale Municipal Code is hereby amended by amending Table 19.32.020 to read as follows:

SECTION 3. SECTION 19.40.030 AMENDED. Section 19.40.030 of the Sunnyvale Municipal Code is hereby amended by amending Subsection (a)(4) to read as follows:
19.40.030. Buildings that are attached to the house which extend into the side yard setback.
(a) No planning permit is required for buildings that are attached, or immediately adjacent, to the principal structure and are located three feet or more from the side property line provided:

(4) Lot coverage of forty-five percent is not exceeded, unless otherwise approved by a miscellaneous plan permit.

SECTION 4. SECTION 19.40.040 AMENDED. Section 19.40.040 of the Sunnyvale Municipal Code is amended by amending Subsections (a)(5) and (b)(5) to read as follows:
19.40.040. Building area of one hundred twenty square feet or less.
(a) If the area of the accessory utility building is less than one hundred twenty square feet and the height is less than six and one-half feet, then no planning permit is required, so long as the building:
(1)-(4) [Text unchanged.]
(5) In combination with all other buildings on the site, do not exceed maximum allowable lot coverage of forty-five percent, unless otherwise approved by a miscellaneous plan permit.
(b) If the area of the accessory utility building is less than one hundred twenty square feet and the building height is greater than six and one-half feet, then no planning permit is required, so long as the building:
(1)-(4) [Text unchanged.]
(5) Lot coverage of forty-five percent is not exceeded, unless otherwise approved by a miscellaneous plan permit.

SECTION 5. EXEMPTION FROM CEQA. The City Council finds, pursuant to Title 14 of the California Code of Regulations, Section 15061(b)(3), that this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a Project which has the potential for causing a significant effect on the environment.
SECTION 6. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days from and after the date of its adoption.
SECTION 7. POSTING AND PUBLICATION. The City Clerk is directed to cause copies of this ordinance to be posted in three (3) prominent places in the City of Sunnyvale and to cause publication once in an adjudicated newspaper of general circulation in the City of Sunnyvale, of a notice setting forth the date of adoption, the title of this ordinance, and a list of places where copies of this ordinance are posted, within fifteen (15) days after adoption of this ordinance.
