A public hearing will be held by the Administrative Hearing Officer at City Hall, 456 West Olive Avenue, Sunnyvale, CA for the purpose of considering the following applications:

CALL TO ORDER   

   1.  2004-0963 – Geddes Ulinskas [Applicant]: Application for a Variance on a 5,250 square-foot site to allow a first and second story addition to a one story home (Historic Resource) for a total of 1,737 square feet resulting in a 33% Floor Area Ratio.  The property is located at 321 Flora Vista Avenue in an R-2 (Low-Medium Density Residential) Zoning District.  (APN: 209-24-062) KD ( This item will be continued to the Administrative Hearing of January 26, 2005)

   2.  2004-0907 – Off The Hookah Lounge [Applicant] Dubrovnik Associates [Owner]: Application for a Special Development Permit on a 5,271 square-foot site to allow dancing at a smoking lounge from 8 p.m. to 12 a.m. Sunday thru Thursdays and 8 p.m. to 2 a.m. Fridays and Saturdays.  The property is located at 198 South Murphy Avenue in a DSP-2 (Downtown Specific Plan - Block 2) Zoning District. (APN: 209-06-026) DO

    3.   2004-0938– Richard Kingsbury [Applicant] De Victoria Martha [Owner]: Application for related proposals on a 6,914 square-foot site located at 275 Roosevelt Avenue in an R-2 (Low-Medium Density Residential) Zoning District. (APN: 204-45-001) TZ;

  ·       Variance to allow a  fence exceeding seven feet in height within the corner vision triangle on the corner of Roosevelt and Banning Avenues, and

  ·       Use Permit to allow a fence exceeding seven feet in height along Banning Avenue.

   4.   2004-0929 – B2 Perfection [Applicant] S. O. McDonald Enterprises Inc. [Owner]: Application for Use Permit on a 1.2-acre site to allow autobody and general auto repair in an existing building.  The property is located at 150 North Wolfe Road in an M-S (Industrial & Service) Zoning District. (APN:  205-43-028) TZ

PLEASE TAKE NOTICE that if you file a lawsuit challenging any final decision on any public hearing item listed in this agenda, the issues in the lawsuit may be limited to the issues which were raised at the public hearing or presented in writing to the City at or before the public hearing.  PLEASE TAKE FURTHER NOTICE that Code of Civil Procedure section 1094.6 imposes a 90-day deadline for the filing of any lawsuit challenging final action on an agenda item which is subject to Code of Civil Procedure section 1094.5.
