A public hearing will be held by the Administrative Hearing Officer at City Hall, 456 West Olive Avenue, Sunnyvale, CA for the purpose of considering the following applications:

CALL TO ORDER

   1.  2004-0367 – Application for Use Permit on a 7,234 square foot site to allow an eight-foot-high side and rear yard fence.  The property is located at 1052 Marigold Court in an R-0 (Low-Density Residential) Zoning District.  (APN: 213-28-017) RK (Applicant requests for an indefinite continuance)

   2.  2004-0464 – Robin Ellner [Applicant] George Yamaoka and Misako Trustee [Owner]: Application for a renewal of a Use Permit for a social club on a 1.5-acre site and to allow expanded hours and monthly special event.  The property is located at 1155 Reed Avenue in an M-S (Industrial & Service) Zoning District.  (APN: 213-01-003) KD

  3. 2004-0475 – Sandra Steele [Applicant] Donmoyer Timothy Trustee [Owner]: Application f or a Use Permit on a 5.8-acre site to allow a c-location of six antennas on an existing 90-foot lattice tower.  The property is located at 111 Uranium Drive in an M-S (Industrial & Service) Zoning District.  (APN: 216-27-047) DO

   4. 2004-0484 – Application for a Variance from Sunnyvale Municipal Code section 19.26.100 to allow an air conditioner between the building and along South Pastoria Avenue.  The property is located at 795 West McKinley Avenue in an R-2 (Low-Medium Density Residential) Zoning District.  (APN: 165-12-014) RK

PLEASE TAKE NOTICE that if you file a lawsuit challenging any final decision on any public hearing item listed in this agenda, the issues in the lawsuit may be limited to the issues which were raised at the public hearing or presented in writing to the City at or before the public hearing.  PLEASE TAKE FURTHER NOTICE that Code of Civil Procedure section 1094.6 imposes a 90-day deadline for the filing of any lawsuit challenging final action on an agenda item which is subject to Code of Civil Procedure section 1094.5.
