A public hearing will be held by the Administrative Hearing Officer at City Hall, 456 West Olive Avenue, Sunnyvale, CA for the purpose of considering the following applications:

CALL TO ORDER

 

    1.  2004-0367 – Application for Use Permit on a 7,234 square foot site to allow an eight-foot-high side and rear yard fence.  The property is located at 1052 Marigold Court in an R-0 (Low-Density Residential) Zoning District.  (APN: 213-28-017) RK (Item continued to the Administrative Hearing of July 14, 2004)

 

    2.  2004-0097NSA Wireless [Applicant] Pacific Gas & Electric Co. [Owner]: Application on a 35,100 square foot site for a Variance from SMC (Sunnyvale Municipal Code) section 19.32.020 to allow a six-foot and eight-inch extension to an existing 93-foot PG & E tower for a total of 99 feet and 8 inches where a maximum structure height of 55 feet is allowed.  The property is located at 602 East Weddell Drive in an R-0 (Low Density Residential) Zoning District (APN:  110-15-019) CC

 

 

  3.   2004-0441 – Application for related proposals on a 4,615 square-foot site located at 206 East California Avenue in an R-1.5 (Low-Medium Density Residential) Zoning District.  (APN: 204-48-034) DO

 

·         Design Review to allow the placement of a two-story house on an existing lot, and

·         Variance from SMC (Sunnyvale Municipal Code) section 19.34.030 to allow a front yard setback of 10 feet where 20 feet is required for the main house and a rear yard setback of 0 ft. where 10-feet is required for the detached garage, and

·         Use Permit to allow a detached garage greater than 450 square feet.

 

 

 

  4.    2004-0330 – Application for a Variance from SMC (Sunnyvale Municipal Code) section 19.34.030 to allow a 10-foot and 10-inch front yard setback where twenty feet is required.  The property is located at 1351 Pauline Drive in an R-0 (Low Density Residential) Zoning District. (APN: 309-07-008) CC

PLEASE TAKE NOTICE that if you file a lawsuit challenging any final decision on any public hearing item listed in this agenda, the issues in the lawsuit may be limited to the issues which were raised at the public hearing or presented in writing to the City at or before the public hearing.  PLEASE TAKE FURTHER NOTICE that Code of Civil Procedure section 1094.6 imposes a 90-day deadline for the filing of any lawsuit challenging final action on an agenda item which is subject to Code of Civil Procedure section 1094.5.
