2003-0769 – Application for a Special Development Permit on a 5,385 square foot site to allow a pre-fabricated patio enclosure in the rear property resulting in a 59% FAR (Floor Area Ratio). The property is located at 1157 White Pine Terrace in an R-1.5/PD (Low Medium Density Residential/Planned Development) Zoning District. (APN: 213-11-056) RK
In attendance: Sony Wong, Applicant; Trudi Ryan, Administrative Hearing Officer; Ryan Kuchenig Project Planner; Jaime McLeod, Associate Planner; and, Gloria Barron, Recording Secretary.
Ms. Trudi Ryan, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.
Ms. Ryan announced the subject application.
Ryan Kuchenig, Project Planner, presented the staff report. He summarized the subject application and recommended approval of the Special Development Permit subject to the Conditions of Approval.
Ms. Ryan asked staff what the Floor Area Ratio for the additional units in the subdivision were. Staff responded that the Floor Area Ratio for the additional units ranged from 51% to 54% and noted that the subject unit was the largest unit. Ms. Ryan then asked why staff was recommending that the patio enclosure not be converted into living space. Staff responded that due to the nature of the structure and materials used staff was not comfortable with the possibility of using the structure for habitable purposes. Ms. Ryan confirmed with staff that if the patio enclosure were of a different design with more architectural similarities as the building staff would be more comfortable that it would be permanent space. Staff agreed.
Ms. Ryan opened the public hearing.
Sony Wong, Applicant, received and reviewed a copy of the staff report. He stated that he agreed with the Conditions of Approval recommended by staff. Ms. Ryan clarified with Mr. Wong that the structure will follow the angles associated with the existing pad. Mr. Wong agreed.
Ms. Ryan closed the public hearing.
Ms. Ryan approved the Special Development Permit with the Findings provided by staff and the Conditions of Approval recommended by staff.
Ms. Ryan stated that the decision is final unless appealed during the 15-day appeal period.
The meeting was adjourned at 2:07 p.m.
