2003-0896 - Gregory Gibbs [Applicant] Pacific Retail Trust [Owners] - Application for a Special Development Permit on a 7.5-acre site (Loehmann's Plaza) to allow a women's gym in an existing retail tenant space. The property is located at 1673 Hollenbeck Road in a C-1/PD (Neighborhood Business/Planned Development) Zoning District. (APN: 323-26-033) JM
In attendance: Greg Gibbs, Applicant; Trudi Ryan, Administrative Hearing Officer; Jamie McLeod, Project Planner; Gerri Caruso, Principal Planner; and, Gloria Barron, Recording Secretary.
Ms. Trudi Ryan, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.
Ms. Ryan announced the subject application.
Jamie McLeod, Project Planner, presented the staff report. She summarized the subject application and recommended approval of the Special Development Permit subject to the Conditions of Approval.
Ms. Ryan clarified with staff that no building permits were required for the proposed configuration and the application was zoned under recreational facility. Ms. Ryan then asked if there would be adequate parking on the site if they had scheduled classes. Staff responded that there would still be adequate parking spaces. Ms. Ryan then referred to the hours of operation and asked staff if the hours were consistent with the shopping center hours. Staff responded that the Condition’s of Approval reflect the hours suggested by the applicant.
Ms. Ryan opened the public hearing.
Greg Gibbs, Applicant, received and reviewed a copy of the staff report. He stated that there were some revisions to the staff report. He noted that they would be closed on Sunday’s and the customers would range from 8 to 11 customers with 2 employees at any given time. Mr. Gibbs added that the hours of operation would be from 8:00 a.m. to 8:00 p.m. and closed from noon to 2:00 p.m. during lunch hours.
Ms. Ryan confirmed with staff that the maximum number of customers allowed by the fire code would not be a significant impact on the parking. Staff agreed.
Ms. Ryan closed the public hearing.
Ms. Ryan stated that the facility is being treated as a general fitness facility to allow flexibility for the site so that a different franchise would have the opportunity to accommodate children and adults. Ms. Ryan approved the Special Development Permit for an exercise facility and adopted the Findings provided by staff with the Conditions of Approval recommended by staff with a modification to the hours of operation which would allow the facility to operate from 7:00 a.m. to 10:00 p.m. any day of the week.
Ms. Ryan stated that the decision is final unless appealed during the 15-day appeal period.
The meeting was adjourned at 2:39 p.m.
