ADMINISTRATIVE HEARING

2003-0925 - Anthony Quinton [Applicant] Souzah & Safwat Gaballah [Owners] - Application for a Special Development Permit on a 4-acre site (Mary Manor Plaza) to allow a new dry cleaning service. The property is located at 251 S. Mary Avenue in a C-1/PD (Neighborhood Business/Planned Development) Zoning District. (APN: 161-37-087) KD
In attendance: Anthony Quinton, Applicant; Trudi Ryan, Administrative Hearing Officer; Kelly Dieckmann, Project Planner; Gerri Caruso, Principal Planner; and, Gloria Barron, Recording Secretary.
Ms. Trudi Ryan, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.
Ms. Ryan announced the subject application.
Kelly Diekmann, Project Planner, presented the staff report. He summarized the subject application and recommended approval of the Special Development Permit subject to the Conditions of Approval.
Ms. Ryan referred to Condition of Approval #11 and asked staff if the intent was to have the item return to a public hearing if venting of chemical emissions from the dry cleaning process required approval from the Director of Community Development. Staff agreed. Ms. Ryan asked staff if the hours of operation were consistent with the hours of the shopping center. Staff responded that they did have the same general limits as the original Use Permit.
Ms. Ryan opened the public hearing.
Anthony Quinton, Applicant, did not receive a copy of the staff report. Ms. Ryan deferred discussion on the item to allow Mr. Quinton to take a few minutes to read and review the staff report and Conditions of Approval.
Up come reconvening the item Ms. Ryan asked Mr. Quinton if he had any questions. Mr. Quinton asked for clarification on Condition of Approval #7. Staff explained the permits required from the City of Sunnyvale Fire prevention and from the State. Ms. Ryan asked Mr. Quinton if he was anticipating laundry services or just dry cleaning services. Mr. Quinton responded that the facility would provide on-site dry cleaning services only and that laundry could be shipped off-site.
Ms. Ryan closed the public hearing.
Ms. Ryan approved the Special Development Permit with the Findings recommended by staff and Conditions of Approval suggested by staff with a modification to Condition of Approval #12 to state that: After approval of a Mater Sign Program subsequent individual sign permits may be submitted for review. Ms. Ryan added Condition of Approval #13 to state: Change in dry cleaning equipment to a different type will require review by the Director of Community Development to determine if additional environmental review is required and if so it would need to be determined at a public hearing.
Ms. Ryan stated that the decision is final unless appealed during the 15-day appeal period.
The meeting was adjourned at 2:41 p.m.
