2003-0947Fonzy Kuo [Applicant] Vimal Kumar [Owner] – Application for a Use Permit on a 2.6 acre site for a restaurant in an existing building.  The property is located at 830 East El Camino Real in a C-2 (Highway Business) Zoning District. (APN: 211-25-003) KD

 

In attendance: Fonzy Kuo, Applicant; Vimal Kumar, Owner; Fred Bell, Administrative Hearing Officer; Kelly Diekmann, Project Planner; and, Gloria Barron, Recording Secretary. 

 

Mr. Fred Bell, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.

 

Mr. Bell announced the subject application.

 

Kelly Diekmann, Project Planner, presented the staff report.  He summarized the subject application and recommended approval of the Use Permit subject to the Conditions of Approval recommended by staff. 

 

Mr. Bell announced that he read the staff report and visited the site.  He then referred to the Conditions of Approval and made modifications to Condition of Approval #10, #11, #13, and #14 by adding the words “and approval”. Mr. Bell then referred to Condition of Approval #9 and asked staff for clarification.  Staff clarified that the condition is intended to protect any glare from occurring and stated that anything shining up at a wall would probably not be appropriate.  Mr. Bell asked staff for clarification on Condition of Approval #10f.  Staff stated that wood trim is not required but is encouraged.  Mr. Bell modified the condition to state that “other” accents into the design may be used.  Mr. Bell referred to Condition of Approval #14e and deleted the word “at” from the sentence.  He then referred to Condition of Approval #14g and asked staff if the intention was to have the area totally screened so that cars are not visible.  Staff responded that three to four feet shrubs would be desired for screening.     

 

Mr. Bell opened the public hearing.

 

Fonzy Kuo, Applicant, stated that the owner’s intent is to remodel the interior and exterior of the restaurant and offer a buffet style restaurant.  Mr. Kuo stated that currently the owner has two other successful restaurants and he plans to bring a lot of business into Sunnyvale.  He also noted that the owner reviewed the Conditions of Approval and agreed to comply with the recommended conditions.  Mr. Kuo stated that he is not familiar with the wood trim design and would like to further work with the project planner to better understand what is being asked.  Staff stated that attachment 6 illustrates an example of what wood trim looks like. 

 

Mr. Bell closed the public hearing.

 

Mr. Bell concurred with the Findings provided by staff and approved the Use Permit with the Conditions of Approval recommended by staff with modifications to #10, #11, #13, and #14 to include the words “and approval” also #10f to include the word “other” accents.

 

Mr. Bell stated that the decision is final unless appealed during the 15-day appeal period.

 

The meeting was adjourned at 1:15 p.m.
