2004-0012 – Leticia R. Guiao [Applicant] Eddy Shen [Owner] – Application for a Special Development Permit on a 16,988 square foot site to allow a training school in an existing office building. The property is located at 102 Persian Drive in a C-1/PD (Neighborhood Business/Planned Development) Zoning District. (APN: 110-11-066) RK
In attendance: Leticia R. Guiao, Applicant; Gerri Caruso, Administrative Hearing Officer; Ryan Kuchenig, Assistant Planner; Diana O’Dell, Senior Planner; and, Gloria Barron, Recording Secretary.
Ms. Gerri Caruso, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.
Ms. Caruso announced the subject application.
Ryan Kuchenig, Project Planner, presented the staff report. He summarized the subject application and noted that negative feedback was not received from the public or surrounding properties. Staff recommended approval of the Special Development Permit subject to the Conditions of Approval.
Ms. Caruso opened the public hearing.
Leticia Guiao, Applicant, received and reviewed a copy of the staff report. She did not have any questions or comments. Ms. Caruso noted that she visited the site and had a difficulty locating the “Do not Enter” sign near the driveway. She asked Ms. Guiao if the sign could be made bigger or painted brighter so that it is visible to the public. Ms. Guiao agreed. Ms. Caruso referred to Condition of Approval #7 which states that the facility is limited to a maximum of 15 students, and asked Ms. Guiao if she agreed with the condition. Ms. Guiao stated that she would prefer to have 15 students allowed downstairs and 15 students allowed upstairs. Staff clarified that the condition was to allow 15 students total at one time. Ms. Caruso added that based on the staff report and the analysis there would not be adequate parking at the site to have that many students overlapping at one time. Ms. Caruso noted that staff and office area were allowed but the number of students is limited to 15 students.
Ms. Caruso closed the public hearing.
Ms. Caruso approved the Special Development Permit subject to the Findings in attachment 1 and subject to the Conditions of Approval in attachment 2 with a modification to attachment #6 to state that both the entrance sign and exit sign of the parking will be enlarged or enhanced to be more readable. Ms. Caruso clarified that condition #7 limits the facility to a maximum of 15 students at any particular time however other staff or faculty workers could be at the site at the same time.
Ms. Caruso stated that the decision is final unless appealed during the 15-day appeal period.
The meeting was adjourned at 2:16 p.m.
