2004-0249 - Abigail O’Connell [Applicant] Lucerne Properties, LLC. [Owner]: Application for a Use Permit on a 1.61 acre site to allow a ceramic art studio and pottery classes in an industrial building.  The property is located at 790 Lucerne Drive in an M-S (Industrial & Service) Zoning District. (APN:  205-32-005) SL

 

In attendance: Abigail O’Connell, Applicant; Gerri Caruso, Administrative Hearing Officer; Steve Lynch, Project Planner; and, Gloria Barron, recording secretary. 

 

Ms. Gerri Caruso, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.

 

Ms. Caruso announced the subject application.

 

Steve Lynch, Project Planner, presented the staff report.  He summarized the subject application and noted that the center will offer full-time memberships on a 24 hour basis and paying students will only have access Monday through Saturday.  Staff recommended approval of the Use Permit subject to the Conditions of Approval recommended by staff. 

 

Ms. Caruso confirmed with staff that the Department of Public Safety did not have any concerns with people using the building on a 24 hours basis.  Staff stated that they did not express any concerns. 

 

Ms. Caruso opened the public hearing.

 

Abigail O’Connell, Applicant, reviewed a copy of the staff report and agreed to the Conditions of Approval.  She asked Ms. Caruso about the 15 day appeal period process. Ms. Caruso stated that the appeal process is for 15 days and anyone has the opportunity to appeal the item to the Planning Commission. 

 

Ms. Caruso closed the public hearing.

 

Ms. Caruso approved the Use Permit with the Findings provided by staff with a modification to Condition of Approval #8 to clarify that if the center requires additional parking spaces than those allowed, a Miscellaneous Plan Permit shall be filed or if the application is a major application a public hearing will be required. 

 

Ms. Caruso stated that the decision is final unless appealed during the 15-day appeal period.

 

The meeting was adjourned at 2:10 p.m.
