Wednesday, September 29, 2004
2004-0699 – David P. Kuo, Ying Dong, and Kuo Enterprises [Applicant] 1963 Yvonne Jacobson Trust Et Al [Owner]: Application for a Special Development Permit on a 4.23-acre site to allow a 3,000 square-foot restaurant and juice bar in an existing shopping center (Civic Square Center). The property is located at 808 West El Camino Real in a C-2/PD (Highway Business/Planned Development) Zoning District. (APN: 201-21-005)
In attendance: Simon Lin, Architect Representative; David Kuo; Gerri Caruso, Administrative Hearing Officer; Jamie McLeod, Project Planner; and, Gloria Barron, Recording Secretary.
Ms. Gerri Caruso, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.
Ms. Caruso announced the subject application.
Jamie McLeod, Project Planner, presented the staff report. She summarized the subject application and noted that the Special Development Permit was for two separate restaurant uses. Staff recommended approval of the Special Development Permit subject to the Conditions of Approval recommended by staff.
Ms. Caruso referred to Condition of Approval #8 and #13 regarding the patio and asked staff if one of the conditions could be eliminated because they appeared to be the same. Staff responded that the conditions were different and asked that they remain as is.
Ms. Caruso opened the public hearing.
Simon Lin, Architect Representative, stated that he received and reviewed a copy of the staff report. He stated that he did not have any questions regarding the Conditions of Approval. Ms. Caruso referred to the exterior improvements proposed and asked Mr. Lin if there was a way he could improve and update the façade of the building without removing the wooden arbor. Mr. Lin stated that the wooden arbors which he referred to as trellis would remain and noted that he intends to paint the trellis a dark green throughout the side of the building.
Mitsy Smith stated she was the Property Manager. Ms. Caruso asked Ms. Smith if the intent was to paint the trellis so that it would match the entire shopping center. Ms. Smith stated that a letter was sent to the applicant requesting a color scheme but was unaware that they wanted to paint the trellis a dark green. Ms. Smith stated that it was not their intent to re-paint the trellis and was not sure if the color scheme would be in keeping with the shopping center.
Ms. Caruso closed the public hearing.
Ms. Caruso approved the Special Development Permit with the Findings provided by staff and with the Conditions of Approval recommended by staff with an additional condition to state that the color of trellis can only be modified if the trellis is painted consistently for the entire shopping center. Mr. Lin asked permission to ask an additional question and asked Ms. Caruso if the hours of operation for the juice bar could be extended to 11:00 p.m. Ms. Caruso asked staff if the shopping center or a previous Use Permit would not allow the extended hours. Staff stated that she was not aware of permitted hours for the shopping center. Ms. Caruso stated that she would like to review the hours with the property manager and also see how close the surrounding houses are to the shopping center. Ms. Caruso added a condition that the Director of Community Development could modify the hours of operation at a later time.
Ms. Caruso stated that the decision is final unless appealed during the 15-day appeal period.
