Wednesday, October 13, 2004

 

2004-0736Banjara Indian Cuisine [Applicant] Dubrovnik Associates, Inc., Et Al [Owner]: Application for a Special Development Permit on a 17,860 square foot site to allow the expansion of hours of operation for dancing and entertainment.  The property is located at 407 Town and Country in a DSP/1A (Downtown Specific Plan / Block 1A) Zoning District.  (APN: 209-07-014) RK

 

In attendance: Venkateswarlu Muvva, Applicant; Gerri Caruso, Administrative Hearing Officer; Ryan Kuchenig, Project Planner; and, Gloria Barron, Recording Secretary. 

 

Ms. Gerri Caruso, Administrative Hearing Officer, on behalf of the Director of Community Development, explained the format that would be observed during the public hearing.

 

Ms. Caruso announced the subject application.

 

Ryan Kuchenig, Project Planner, presented the staff report.  He summarized the subject application and noted that Condition of Approval #2 should be modified to state that the hours of operation on Friday, Saturday, and Sunday shall be no later than 2 am.  Staff noted that he verified with Public Safety regarding the change in hours of operation and stated that there were no concerns. Staff recommended approval of the Special Development Permit subject to the Conditions of Approval recommended by staff. 

 

Ms. Caruso asked staff what the interior of the restaurant currently looked like.  Staff referred to the site plan and noted what is currently there and stated that there are tables and chairs that can easily be moved. 

 

Ms. Caruso opened the public hearing.

 

Venkateswarlu Muvva, Applicant, stated that he received and reviewed a copy of the staff report.  Ms. Caruso confirmed with Mr. Muvva that the only modification to the conditions was the change in hours of operation.  Mr. Muvva agreed and stated that he is in compliance with everything else. 

 

There was no one else to speak on the item. 

 

Ms. Caruso closed the public hearing.

 

Ms. Caruso approved the Special Development Permit with the Findings provided by staff and with the Conditions of Approval recommended by staff with a modification to condition #2 to reflect that Friday, Saturday, and Sunday hours of operation will be no later than 2 a.m.

 

 

Ms. Caruso stated that the decision is final unless appealed during the 15-day appeal period.

 

The meeting was adjourned at 2:43 p.m.
