A regular meeting of the Sunnyvale Planning Commission was held on December 15, 2003, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Babcock presiding.

Approval of Minutes

Comm. Simons made a motion to approve the minutes of November 24, 2003 with modifications. Vice Chair Moylan seconded. |
Report on Council Meeting
Trudi Ryan, Planning Officer, reported that on December 2, City Council considered 17 townhomes located at Crescent Avenue. The Council approved 16 townhomes and added an architectural condition to be more of a southwest style design.
Further, she reported that the City Council initiated a general plan amendment study to an industrial zoning district for a residential use in accordance with staff recommendation.
Ms. Ryan also reported that the Redevelopment Agency considered the parcels for master development area of Block 18 to allow for development.
Ms. Ryan reminded the Commission that the 2004 Study Issue Workshop will on Thursday, December 18 starting at 8:30AM. The Workshop is open to the public and will be televised; however, no public testimony will be heard.
Planning Officer’s Report
Ms. Ryan reported that the Annual Study Issue Workshop to be held on Thursday, December 18 and that Council will select and rank the 2004 study issues. She noted that Community Development has 34 study issue items.
Citizens To Be Heard
Chair Babcock announced that there are openings in several Boards & Commissions. She encouraged the public to be involved. The application deadline is on Friday, December 26 at 5PM and to call 408/730-7595 for further information.

- 2003-0825 – Rita & Stanley Lee [Applicant/Owner] – Application for a Special Development Permit on a 27,460 square foot site to allow for 1,186 square feet of retail use for an existing building. Vice Chair Moylan made a motion on Item #2003-0825 to deny the Special Development Permit. Comm. Simons seconded. Motion carried 4-0. |

Comm. Simons made a motion on Item #2003-0827 to deny the appeal and uphold the decision of the Director of Community Development denying the removal of the Podocarpus tree. Comm. Hungerford seconded. Motion carried 3-1 with Vice Chair Moylan dissenting. |

Vice Chair Moylan made a motion on Item #2003-0850 to adopt the Negative Declaration and approve the Use Permit with modifications: 1) to remove Condition of Approval #12, 2) to modify Condition of Approval #6 to require a Transportation Demand Management Program (TDM) to be submitted to Community Development Department and be subject to a recurring six month review. Comm. Simons seconded. Motion carried 4-0. |

Application for related proposals on a 15,816 square foot site located at 821-823 and 825-829 Lewis Avenue in an R-2 (Low Medium Density Residential) Zoning District. (APN: 165-17-027) (Negative Declaration) DO
- Variance from SMC (Sunnyvale Municipal Code) section to allow SMC 19.30.020 to allow less than the required minimum lot size and width, and
- Parcel Map to allow the subdivision of one lot into two lots.

Vice Chair Moylan made a motion on Item #2003--0459 to adopt the Negative Declaration and approve the Variance and Tentative Map. Comm. Hungerford seconded. Motion carried 4-0. |
