SUNNYVALE planning commission

 

The Planning Commission met in regular session in the Council Chambers, City of Sunnyvale, 456 W. Olive Avenue, Sunnyvale, CA on January 10, 2005 at 8:00p.m. with Chair Moylan presiding.

Comm. Simons made a motion to approve the minutes of December 13, 2004 with minor modifications. Comm. Klein seconded.   Motion carried 7-0.

PUBLIC HEARINGS/GENERAL BUSINESS

 

1.     2004-0918 - SABA Inc. [Applicant] James S and Sallry K. Lindsey Et Al [Owner]: Application for a Use Permit on a 3-acre site to allow a new community center within a portion of an existing industrial building.  The property is located at 1213 Elko Drive in an M-S (Industrial & Service) Zoning District. (APN: 104-32-029) (Negative Declaration) GC

ACTION:  Comm. Fussell made a motion on Item #2004-0918 to continue to January 24, 2005.  Comm. Sulser seconded.  Motion carried unanimously 7-0.

 

APPEAL OPTIONS:  Item no appealable, to be considered on 01/24/05.

 

2.     2004-0857 - Iraj Dehnow [Applicant] Ray and Stella Underhill Trustee [Owner]: Application for related proposals on a 12,120 square-foot site located at 1276 Poplar Avenue in an R-2 (Low Medium Density Residential) Zoning District. (APN: 213-44-034)  KD  (Continued from 12/13/04)

·         Rezone from R-2 (Low-Medium Density Residential) to R-2/PD (Low-Medium Density Residential/Planned Development) Zoning District;

·         Special Development Permit to remove two homes and construct three new homes, and

·         Parcel Map to subdivide one lot into four lots.

 

 

ACTION:  Comm. Babcock made a motion on Item #2004-0857 to recommend the Rezone from R-2 to R-2/PD and approve the Special Development Permit and Parcel Map with modifications – 1) that the project meets all setback requirements; 2) that the total square footage of the buildings shall be reduced to meet the usable open space requirement; 3) that the total Floor Area Ratio shall be reduced to 50%, and 4) that stormwater maintenance standards and materials be added to the landscaping plan.  Comm. Simons seconded.  Motion carried unanimously 7-0.

 

APPEAL OPTIONS: Item will be considered by City Council on 1/25/05.

 

3.     2004-0922 - Ramasatya K. Rao [Applicant] Jimmy R. Chitwood Trustee [Owner]: Application for a Use Permit on a 6,598 square-foot site to allow a large family day care to be located within 300 feet of an existing large family day care, for up to 14 children.  The property is located at 717 Old San Francisco Road in an R-0 (Low-Density Residential) Zoning District. (APN: 209-17-045) AM

ACTION:  Comm. Simons made a motion on Item #2004-0922 to deny the Use Permit.  Vice Chair Hungerford seconded.  Motion carried 6-1 with Chair Moylan dissenting.

 

APPEAL OPTIONS:  Item is appealable to the City Council no later than Tuesday, 1/25/05.

 

4.     2004-0916 - Dan Winklebleck [Applicant]:  Application for a Design Review on a 6,320 square-foot site to allow the construction of a new 3,799 square-foot two-story home resulting in a 60% Floor Area Ratio where 45% may be considered without Planning Commission Review.  The property is located at 1614 Grosbeak Avenue in an R-0 (Low Density Residential) Zoning District. (APN: 309-48-012) KD

ACTION:  Comm. Sulser made a motion on Item #2004-0916 to approve the Design Review as recommended by staff subject to Conditions of Approval.  Comm. Babcock seconded.  Motion carried 7-0.

 

APPEAL OPTIONS:  Item is appealable to City Council no later than Tuesday, 1/25/05.

 

5.     2004-0852 - Rob Moore [Applicant] Evelyn LLC [Owner]: Application for related proposals on a 1.2-acre site located at 1136-1142 West Evelyn Avenue in an M-S (Industrial and Service) Zoning District. (APN: 161-31-035) (Negative Declaration) JMc

·         Use Permit to allow construction of four condominium units, and

·         Parcel Map to subdivide one lot into four condominium lots and one common lot.

 

ACTION:  Comm. Sulser made a motion on Item #2004-0852 to approve the Use Permit with modifications – 1) that a minimum of 50 parking spaces shall be provided; 2) that landscaping shall be maximized.  Vice Chair Hungerford seconded. Motion carried 6-1 with Comm. Simons dissenting.

 

APPEAL OPTIONS:  Item is appealable to the City Council no later than Tuesday, 1/25/05.

 

6.     2002-0070 - City of Sunnyvale Study Issue – In-lieu Fee For The Undergrounding of Utilities: This study evaluates and asks for direction on a series of alternatives intended to enhance the implementation of the undergrounding of overhead utilities throughout the City.  Alternatives will include consideration of an in-lieu fee, deferral agreements, development fees and the creation of assessment districts.  (Negative Declaration) AM (Continued from 12/13/04)

Vice Chair Hungerford made a motion on Item #2002-0070 for an indefinite continuance.  Comm. Sulser seconded.  Motion carried unanimously 7-0.


NON-AGENDA ITEMS AND COMMENTS

 

  • COMMISSIONERS ORAL COMMENTS

 

Comm. Simons commented that the December/January issue of the Dwell Magazine, featured Scott Ward’s award winning development project in Palo Alto.  Mr. Ward has several housing development projects in the City.

 

  • STAFF ORAL COMMENTS

 

City Council Meeting Report

 

Trudi Ryan, Planning Officer, wished the Commission a Happy New Year.

 

She reported that on 12/14/04, the City Council considered initiation of a General Plan Amendment Study on a property located at Duane and DeGuigne (part of the Advance Micro Devices campus).  City Council did not initiate the requested study but directed staff to do an extended study to include neighboring sites. 

 

Further, she reported that on 12/21/04 staff updated the City Council on the expanded single-family home additions noticing.  Council approved staff’s recommendation to discontinue the expanded noticing and to post the site for second story additions and to continue to mail notices to adjacent sites.

 

Ms. Ryan also reported that the City Council started a new agenda format which includes staff recommendation and staff contact name and phone number.

 

Chair Moylan requested to include the agenda item number to each staff report in the Planning Commission packet.

 

Ms. Ryan announced that the chairs the Commission is using will be reupholstered.

 

She also announced that Alice Gamboa-Navas will be moving to Housing Division and it was Alice’s last Planning Commission meeting.  The Commission wished her the best.
