Planning Commission APPROVED ACTION SUMMARY

A regular meeting of the Sunnyvale Planning Commission was held on January 12, 2004, at 8:00 p.m. in the Council Chambers, City Hall, 456 West Olive Avenue, Sunnyvale, with Chair Babcock presiding.

ACTION: Vice Chair Moylan made a motion on Item #2003-0839 to grant the appeal and approve the removal of the Deodar Cedar Tree. Comm. Klein seconded. Motion carried 5-2 with Comms. Simons and Sulser dissenting.
APPEAL OPTIONS: Not appealable, Planning Commission action is final.

- Special Development Permit to allow 18 three-story townhomes on an existing vacant lot, and
- Tentative Map to subdivide one lot into eighteen lots and one common lot.
ACTION: Comm. Simons made a motion on Item #2003-0788 to adopt the Negative Declaration and approve the Special Development Permit and Tentative Map with modifications that Condition of Approval #8 shall be deleted. Comm. Hungerford seconded. Motion carried 6-1 with Vice Chair Moylan dissenting.
APPEAL OPTIONS: May be appealed to City Council no later than 01/27/04.

Report on Council Meetings & Planning Officer's Report
Trudi Ryan, Planning Officer, reported that on December 16, 2003, City Council considered a General Plan Amendment on a project located at the corner of El Camino Real and Mathilda Avenue. The City Council adopted the Planning Commission recommendation.
The City Council also considered an appeal of a decision by the Planning Commission approving a Use Permit for a co-location by AT&T on a tower located on Pastoria Avenue with a condition to replace the existing monopole with a camouflage. The City Council granted the appeal and approved the co-location to the existing monopole. Ms. Ryan reported that a sixth co-location application has been submitted and will soon be before the Planning Commission for consideration.
Ms. Ryan further reported that the City Council also considered the modification to the code where the property owner's signature is required before an application is processed. Because of the controversy, the City Council continued the item indefinitely.
Furthermore, Ms. Ryan reported that the Council also considered an appeal on the San Jose Sabercats tent where the Planning Commission denied the Use Permit. The City Council granted the appeal and approved the Use Permit. However, staff erred where noticing was not accomplished per the Municipal Code. Therefore, a new hearing date of January 6 was scheduled.
On January 6, the City Council approved the Use Permit by a 4-3 vote with modifications and allowing the San Jose Sabercats tent from January 1 through May 15 for two years.
On the same evening, the City Council also considered an appeal on a retail use on the Lee Dental Building located at 1698 S. Wolfe Road. The City Council denied the appeal and upheld the decision of the Planning Commission denying the retail use. The City Council also directed staff to assist the applicant and adjacent property owners to resolve their issues through Project Sentinel.
Ms. Ryan further reported that three Planning Commissioners were appointed by City Council on the same evening. A Heritage Preservation Commissioner was also appointed and she noted that there is still one more vacancy on Heritage Preservation Commission. The Board of Code of Building Appeals also still has one vacancy and noted that this Board is looking for someone who has more knowledge on building construction.
Finally, Ms. Ryan reported that on December 18, the City Council held the 2004 Study Issue Workshop. The results were shared after the study session and will be reflected in the 2004 Work Plan. The Work Plan will be submitted to the Commission for adoption at the next meeting.
Comm. Simons asked staff to clarify the screening condition for the Sabercats tent. Ms. Ryan clarified that the screening is to add color such as green or black to downplay the white color of the tent structure facing Dunford Road. She also reported that the applicant is currently working with staff on the landscaping plan.
